The Georgia Foreclosure Attorney’s primary focus is managing non-judicial foreclosure matters and handling creditor-side default legal work across a high-volume residential and commercial foreclosure portfolio, including judicial foreclosure litigation when required. This attorney oversees the foreclosure process from referral through sale confirmation, ensuring compliance with Georgia foreclosure statutes, notice requirements, investor guidelines, and litigation deadlines where judicial action is necessary.
In addition to core foreclosure responsibilities, this attorney will be expected to handle lightly contested matters that arise on the docket — including borrower disputes, motions for temporary restraining orders, title issues, objections to confirmation, bankruptcy-related coordination, and court appearances connected to foreclosure enforcement or post-sale proceedings — so that files stay on track without requiring escalation. This is not a heavy litigation role; it is a focused, high-output position for an attorney who excels at preparation, creditor-side foreclosure practice, and docket management.

Responsibilities:Non-Judicial Foreclosure Oversight
  • Manage Georgia non-judicial foreclosure matters from referral through foreclosure sale and post-sale processing.

  • Review files for foreclosure readiness, including confirmation of default status, notice compliance, publication requirements, title review, and investor or servicing guideline requirements.

  • Prepare and review notices, acceleration letters, deeds under power, affidavits, and related default documentation in compliance with Georgia law.

  • Coordinate foreclosure sales with staff, auction personnel, publication vendors, and clients to ensure timely and compliant execution.

  • Address post-sale matters including confirmation actions, title issues, surplus claims, motions related to possession, and related file follow-up.

  • Ensure compliance with Georgia foreclosure statutes, investor requirements, bankruptcy restrictions, and applicable federal servicing regulations.

Court Appearances & Hearings
  • Appear in Georgia state courts as needed for contested foreclosure matters, TRO hearings, confirmation hearings, motions, and related proceedings.

  • Prepare thoroughly for each appearance with sufficient lead time, including review of the file, court requirements, and any pending opposing filings.

  • Coordinate with paralegals and staff on scheduling, notice, publication, and all pre-hearing logistics.

  • Report hearing outcomes promptly to the file team and client as required.

  • Handle limited ancillary litigation connected to foreclosure enforcement and creditor remedies.

Judicial Foreclosure & Related Litigation
  • Handle judicial foreclosure matters when required, including preparation and review of pleadings, motions, affidavits, and related litigation filings.

  • Manage contested foreclosure litigation in coordination with clients, servicers, and firm leadership to advance creditor remedies efficiently.

  • Appear in Georgia courts for hearings related to judicial foreclosure enforcement, borrower challenges, and ancillary foreclosure litigation.

Borrower Resolutions & Loss Mitigation Coordination
  • Review loss mitigation status and borrower communications prior to foreclosure sale activity.

  • Coordinate with servicers and clients regarding postponements, workout review periods, reinstatements, and payoff activity.

  • Engage borrowers and opposing counsel professionally, with the goal of reaching resolutions consistent with client objectives.

  • Document borrower communications, postponement decisions, and foreclosure outcomes accurately and coordinate any required follow-up with the file team.

Lightly Contested Matters
  • This attorney will handle routine lightly contested matters that arise within the foreclosure process and must be resolved to keep files moving. This is a support function, not the primary role.

  • Respond to and argue motions for temporary restraining orders or borrower requests seeking to halt foreclosure sales.

  • Address procedural objections, title disputes, or routine court inquiries that do not require escalation to supervising attorneys.

  • Handle confirmation-related issues and coordinate with title curative or bankruptcy counsel as needed.

  • Communicate with the file team on any contested issues requiring strategy input from senior attorneys.


Qualifications:Required Qualifications
  • Active member in good standing of the Georgia Bar.

  • Minimum 1–3 years of experience in Georgia foreclosure law, creditor-side real estate law, or default servicing litigation.

  • Working knowledge of Georgia non-judicial foreclosure procedure, including statutory notice requirements, publication requirements, foreclosure sales, post-sale processes, and judicial foreclosure litigation.

  • Demonstrated courtroom experience, including appearances in Georgia superior courts or related proceedings.

  • Strong preparation habits and professional courtroom presence; ability to handle hearings independently and professionally.

  • Highly organized with the ability to manage a large active foreclosure docket without missing deadlines.

  • Proficient in Microsoft 365 (Word, Outlook, Excel, Teams) and comfortable working across case management and court filing platforms.

  • Professional demeanor and strong written and verbal communication skills.

Preferred Qualifications
  • Experience at a high-volume creditor-side foreclosure or default servicing firm.

  • Familiarity with CaseAware, LPS (Black Knight / ICE), Tempo, or similar foreclosure case management systems.

  • Experience handling residential, commercial, or business purpose loan (BPL) foreclosure matters.

  • Working knowledge of bankruptcy stay issues, title curative matters, and foreclosure confirmation procedures.

  • Creditor-side bankruptcy experience, including familiarity with automatic stay issues, motions for relief from stay, proof of claim coordination, and bankruptcy-related foreclosure restrictions.

  • Florida Bar membership is a plus.
