Job description

Direct Counsel is seeking a Privacy & Digital Risk Class Action Associate with 3–7 years of litigation experience to join a nationally recognized privacy and cybersecurity practice. This is an exceptional opportunity for an attorney interested in defending sophisticated privacy and data security litigation, including high-profile class actions arising from cybersecurity incidents.

The ideal candidate will have experience in complex litigation, privacy law, or class action defense and a strong interest in representing leading national companies in cutting-edge privacy and digital risk matters.

Responsibilities
  • Defend clients in privacy and data security litigation, including consumer class actions.
  • Represent clients in litigation arising from cybersecurity incidents and data breaches.
  • Develop litigation strategy through all phases of litigation, from initial case assessment through resolution.
  • Draft and argue:
    • Motions to dismiss
    • Dispositive motions
    • Briefs
    • Discovery motions
  • Conduct legal research and analyze evolving privacy and cybersecurity laws.
  • Advise clients on litigation risks involving federal and state privacy statutes.
  • Collaborate with multidisciplinary teams handling cybersecurity incident response, regulatory investigations, and related litigation.
  • Manage complex litigation matters while maintaining exceptional client service and responsiveness.
Qualifications
  • J.D. from an accredited law school with a strong academic record.
  • Active admission to the Colorado Bar, or eligibility for admission by waiver.
  • 3–7 years of litigation experience.
  • Experience with privacy litigation, class action defense, or other complex commercial litigation.
  • Excellent legal research, writing, analytical, and oral advocacy skills.
  • Strong organizational and project management abilities with the capacity to manage multiple high-priority matters.
Preferred Qualifications
  • Experience handling privacy and data security litigation.
  • Experience litigating claims arising under laws such as:
    • BIPA
    • FCRA
    • FACTA
  • Familiarity with consumer class action litigation, including:
    • Article III standing
    • Rule 12(b)(6) motion practice
  • Prior experience at an Am Law 100 law firm.
  • California Bar admission is a plus.
  • Law review, judicial clerkship, or other significant legal writing experience.
