Individual contributor responsible for the direct handling and overall management of the most complex, highest exposure claims in the Mass Tort Claims Unit. This individual contributor is recognized as the most senior claims professional. Responsible for handling of claims involving social medial/AI addiction, sexual abuse and molestation, pollution/environmental, toxic chemical exposures, product exposures involving multiple claimants, talc, PFAS/AFFF and other claims that impact multiple policy periods. In conjunction with senior level management, this individual works on assignments requiring the highest degree of technical complexity and coordination of negotiation, litigation management, and coverage-related issues. The position has national scope of claim assignment.

JOB DESCRIPTION:

Essential Duties & Responsibilities

Performs a combination of duties in accordance with departmental guidelines:

  • Assess coverage obligations including analyzing policy language in order to recommend and prepare written coverage determinations. Partners with coverage counsel, as applicable.
  • Manages an inventory of the most complex commercial claims, which generally involve multiple years of coverage, have significant loss exposure, by following company protocols to manage and oversee all aspects of the claim handling, including coverage determinations, investigations, and resolution strategies which may include pursuit of risk transfer, extensive negotiations and management of complex litigation.
  • Ensures exceptional customer service by driving continuous improvements for all aspects of the claim/account, providing professional and timely claims services.
  • Sets and manages timely and adequate reserves considering coverage, liability, and damages.
  • Drives the resolution of claims by collaborating with internal and external business partners to develop, own and execute a claim resolution strategy, that often includes negotiating complex settlements, partnering with counsel to manage complex litigation and authorizing payments within scope of authority.
  • Proactively and independently coordinates, leads, and executes on agreed upon strategies.
  • Prepares and presents high exposure matters to senior leadership, counsel, and others.
  • Maintains subject matter expertise and ensures compliance with state/local regulatory requirements.
  • Mentors, guides, develops and delivers training to less experienced Claim Professionals and may assist with special projects as needed.

May perform additional duties as assigned.

Skills, Knowledge & Abilities

  • Expert knowledge of commercial insurance industry, products, policy language, coverage, issues pertaining to legacy liabilities, and claim practices.
  • Excellent verbal and written communication skills with the ability to develop collaborative working relationships, articulate very complex claim facts, analysis, and recommendations in a concise manner to senior management, as well as with external business partners and customers.
  • Demonstrated analytical and investigative mindset with critical thinking skills and ability to make sound business decisions, and to effectively evaluate and resolve ambiguous and challenging business problems.
  • Extensive experience in leading complex negotiations, as well as developing and implementing resolution strategies.
  • Strong work ethic with demonstrated time management, organizational skills, sound judgment, and an ability to work independently.
  • Ability to drive results by taking a proactive long-term view of business goals and objectives.
  • Ability to partner with internal resources, oversee/manage outside counsel, and collaborate with other carriers.
  • Ability to lead multiple and shifting priorities in a fast-paced environment.
  • Knowledge of Microsoft Office Suite and ability to learn business-related software.
  • Demonstrated ability to value diverse opinions and ideas.

Education & Experience

  • Bachelor's degree with Master's preferred in a related discipline or JD preferred, or equivalent experience.
  • Typically, a minimum of 10 years related work experience such as claims or legal experience with proven track record of success.
  • Latent injury and/or high severity general liability claims experience strongly preferred.
  • Must have or be able to obtain and maintain an Insurance Adjuster License within 90 days of hire, where applicable.
  • Skilled negotiator.

In certain jurisdictions, CNA is legally required to include a reasonable estimate of the compensation for this role. In District of Columbia, California, Colorado, Connecticut, Illinois, Maryland, Massachusetts, New York and Washington, the national base pay range for this job level is $97,000 to $189,000 annually.Salary determinations are based on various factors, including but not limited to, relevant work experience, skills, certifications and location.
