Position Summary
The Attorney will oversee all aspects of commercial and consumer debt recovery, including tenants leasing negotiations, demand letters, payment negotiations, litigation management, filing summary Judgments, judgments, post-judgment collections, and bankruptcy matters. The ideal candidate is proactive, business-minded, and experienced in maximizing recoveries while maintaining compliance with all applicable laws.
Responsibilities
- Fling and managing collection efforts for commercial real estate, multifamily, residential, lands, hunting leases and service industry accounts.
- Draft and send leases, demand letters, notices of default, and settlement agreements.
- Negotiate payment plans, workouts, and settlement agreements with debtors and their counsel.
- File and prosecute lawsuits for unpaid rent, contracts, promissory notes, guarantees, and service agreements.
- Handle tenants evictions, lease enforcement actions, and commercial landlord-tenant disputes.
- Obtain and enforce judgments through garnishments, bank levies, liens, turnover orders, writs of execution, and other post-judgment remedies.
- Coordinate foreclosure proceedings when necessary.
- Review tenant leases, files, contracts, leases, guaranties, invoices, and supporting documentation.
- Work closely with property managers, accounting, asset managers, and operations teams to resolve delinquent accounts.
- Manage outside counsel if litigation is outsourced.
- Represent the company in court hearings, mediations, and settlement conferences.
- Pursue and monitor bankruptcy filings and protect creditor rights.
- Ensure compliance with all applicable federal and state collection laws, including the FDCPA where applicable.
- Recommend strategies to reduce bad debt and improve collection performance.
- Prepare monthly reports detailing collection activities, litigation status, recoveries, and aging accounts.
