The On-Call Assistant Tribal Prosecutor provides professional legal prosecutorial work for the Yakama Nation to defend the Treaty of June 9, 1855 (12 Stat. 951) and the inherent sovereignty of the Yakama Nation. The Assistant Prosecutor provides attorney services in tribal, state, and federal courts for the Yakama Nation. The Assistant Prosecutor represents the Yakama Nation in criminal prosecutions in those jurisdictions as assigned. The Assistant Prosecutor also represents the Yakama Nation in civil court proceeding, including infractions, dependency matters and cases the Yakama Nation becomes involved with pursuant to the Indian Child Welfare Act (ICWA). The Assistant Prosecutor may serve as legal advisor to Law Enforcement consistent with Tribal Policies and at the direction of the Chief Prosecutor. This can involve coordinating with police jurisdictions and other agencies to ensure prosecution activities to serve the interests of the Yakama Nation in protecting the safety of the community. The Assistant Prosecutor maintains contact with attorneys, agencies, and other jurisdictions regarding tribal, state, and federal court matters affecting the Yakama Nation for those cases assigned by the Chief Prosecutor. The Assistant Prosecutor works to support the primary goal of the Prosecutor's Office; to improve safety in the community by working to prevent and reduce criminal activity and victimization on the Yakama Reservation, including the Usual and Accustomed territories, through vigorous and effective prosecution of civil and criminal cases in adult and juvenile courts.
Examples of Work Performed:
Ensure confidentiality of records used by Yakama Nation and law enforcement agencies. Ensures attorney-client privileged documents and physician-patient records are maintained securely and confidentially, ensuring adherence to applicable WA Rules of Professional Conduct.
Evaluates police reports to prepare and present complaints, motions, and other legal documents for civil and criminal matters.
Performs legal research, evaluates legal complexities in each case; analyzes and prepares a wide variety of prosecutions against defendants.
Prosecutes criminal and civil matters before the Yakama Nation Tribal
Works with Yakama Nation Tribal Police and other law enforcement jurisdictions to prepare cases for
Provides input on developing and improving the Yakama Tribal Criminal Justice System, including Tribal Code Development and amendments.
May be assigned to manage the ICWA responses, interventions, transfers of jurisdiction, and appear in court in state jurisdictions throughout the United States.
Provides various legal services, advice, or referrals in criminal and applicable civil
Responsible for developing and maintaining cooperative and collaborative working relationships with Prosecutor and other YN support staff and staff from other tribal and state agencies.
Ability to effectively and sensitively communicate with victims of crime, witnesses of various ages, parents, and other community members.
Responsible for working effectively and with wide latitude for independent judgment and action, and to be accountable to the Chief Prosecutor.
Responsible for understanding tribal sovereignty and treaty rights issues as they relate to representing the Yakama Nation.
May be assigned new projects and tasks as requested by the supervisor not included in the description or assist other staff to ensure the efficient and effective functioning of the work unit.
Knowledge, Skills and Abilities:
Knowledge of governmental management practices.

Minimum Requirements:
Graduation from an accredited School of Law with a Juris Doctor (JD) degree or graduation with Master of Laws (LLM) degree from any university.
Washington State Bar License required, with member in good standing, or obtain WSBA License within the probationary period, admission to practice law in the Yakama Nation Tribal
Required to pass a pre-employment drug and alcohol test and random UAs as required by the Yakama Nation Personnel Policy Manual.
