Job description


We are seeking highly skilled Senior Litigation Attorneys with 8+ years of experience to join our Litigation Practice Group in our Charlotte (CHR), Dallas (DAL), Los Angeles (LA), New York (NY), Raleigh (RAL), San Diego (SD), San Francisco (SFO), Winston-Salem (WS) offices. Remote candidates, who are barred in and live in a state where the firm does business, may be considered. 

This role is ideal for an attorney with substantial experience handling complex commercial litigation matters, particularly involving financial institutions, commercial real estate, and loan servicing disputes.


The ideal candidate will have a strong background leading litigation team in both federal and state courts nationwide and representing financial institutions in high-stakes matters involving distressed commercial real estate assets and secured creditor remedies.


Key Responsibilities

  1. Lead and manage litigation teams in complex commercial matters in federal and state courts across the United States.
  2. Represent banks, master servicers, special servicers, CMBS trusts, insurance companies, and other lenders in:
    1. Workouts of non-performing commercial real estate loans
    2. Forbearances and discounted payoffs
    3. Deeds-in-lieu of foreclosure
    4. Note sales
    5. Receiverships
    6. Judicial and non-judicial foreclosures
    7. Exercise of secured creditor remedies
  3. Handle litigation and loan servicing matters relating to commercial mortgage-backed securities (CMBS).
  4. Represent financial institutions and special servicers in distressed real estate loan matters and commercial property dispositions.
  5. Manage contested bankruptcy matters, UCC sales, mezzanine loan enforcement, and replevin actions.
  6. Protect lenders’ interests in loans secured by:
    1. Hotels
    2. Retail properties
    3. Office and industrial assets
    4. Multifamily and healthcare properties
    5. Ground leases
    6. Pledged personal property interests
  7. Defend financial institutions in lender liability actions, including claims involving:
    1. Breach of contract
    2. Breach of fiduciary duty
    3. Implied covenant of good faith
    4. Fraud and misrepresentation
    5. Partnership/joint venture disputes
    6. Waiver, estoppel, and modification claims
  8. Handle complex business disputes involving contracts, franchise agreements, floorplan financing, real estate matters, and shareholder disputes.
  9. Represent clients in arbitration proceedings, including before the American Arbitration Association (AAA).
  10. Represent title insurance companies in claims involving:
    1. Fraudulent deeds and mortgages
    2. Quiet title actions
    3. Adverse possession
    4. Lien priority disputes
    5. Boundary disputes
  11. Represent landlords and tenants in commercial lease litigation, including:
    1. Ground lease disputes
    2. Evictions and holdovers
    3. Rent reconciliation disputes
    4. Reformation claims
    5. Breach of lease actions

Qualifications

  1. J.D. from an accredited law school.
  2. Active bar admission in the state of the office location (or ability to obtain promptly).
  3. Minimum 8+ years of complex commercial litigation experience.
  4. Significant experience representing financial institutions, servicers, or lenders.
  5. Strong background in commercial real estate litigation and secured creditor remedies.
  6. Experience handling contested matters in both federal and state courts.
  7. Experience managing cases independently and leading litigation teams.
  8. Excellent written and oral advocacy skills.
  9. Strong analytical, strategic thinking, and client management skills.

Preferred Experience

  1. CMBS and loan servicing litigation.
  2. Distressed real estate and mezzanine loan enforcement.
  3. Bankruptcy litigation related to secured lending.
  4. Arbitration experience.
  5. Title insurance litigation.

Expected Salary Range is $295,000 to $315,000
