Job description

Burshteyn Polin LLP is hiring a litigation associate with two to six years of experience. The role may be based in the San Francisco Bay Area or the Denver area.

Our matters include deceptive business practices, intellectual-property and founder disputes, defamation, AI litigation, and plaintiff-side class and mass actions. Our lawyers have managed cases with more than $1 billion in controversy in courts and arbitrations across the country.


You will work with partners and clients, master the evidence, help set strategy, and take real ownership of the result.


The work


The associate will work on matters that may include:


- crypto and blockchain disputes involving founders, investors, funds, exchanges, token projects, fraud, computer access, and regulatory investigations;

- AI litigation involving copyright, data collection, product claims, platform conduct, and other emerging issues;

- defamation, anti-SLAPP, Section 230, Lanham Act, and other speech-related matters;

- trade-secret, copyright, trademark, patent, software-misappropriation, and online-platform enforcement disputes;

- founder, investor, venture-fund, M&A, earn-out, unfair-competition, antitrust, false-advertising, and other complex business disputes;

- plaintiff-side consumer-protection, deceptive-practices, class, mass, and public-entity actions;

- privacy and data-security incident response; and

- urgent TRO, preliminary-injunction, arbitration, trial, and appellate work.


Responsibilities will include:


- drafting pleadings, motions, briefs, and arbitration submissions;

- researching difficult legal and factual questions and turning the work into clear recommendations;

- developing case strategy with partners, clients, experts, and co-counsel;

- managing cases, discovery, ESI, depositions, and case teams with care and judgment;

- preparing witnesses and arguments for hearings, injunction proceedings, trials, and appeals; and

- taking ownership of work, deadlines, and results.


## What we are looking for


- Two to six years of substantive litigation experience.

- Active admission in California for a Bay Area-based candidate or Colorado for a Denver-area candidate.

- Strong writing, research, analysis, and judgment.

- Experience drafting pleadings and briefs, managing discovery, and managing cases.

- The ability to work effectively on a small team, communicate directly with clients, and take ownership of a matter from facts through strategy.

- Experience or serious interest in technology, AI, Internet law, crypto, privacy, cybersecurity, intellectual property, defamation, complex business disputes, or class actions.


Experience at a litigation firm, in a government enforcement role, or in-house managing disputes for a technology company may be helpful, but no single path is required.


## Location and work model


This role may be based in the San Francisco Bay Area or the Denver area. It is a hybrid position with regular in-person work. The associate must be able to work with the firm and clients across time zones and travel for hearings, depositions, trials, and other case needs.


## Compensation and benefits


The anticipated base-salary range is **$125,000โ€“$250,000 per year**, depending on experience, qualifications, location, and other lawful factors.


The position is also eligible for a discretionary bonus.


Benefits include health insurance, paid time off, and payment of bar dues.
