Trademark Associate Attorney (Intellectual Property and Business Law) โ€“ Remote (USA)
Remote (United States)
We are seeking an experienced Trademark Associate Attorney to join a growing, entrepreneurial intellectual property and business law practice. This role is ideal for a hands-on attorney who enjoys managing trademark matters from strategy through enforcement and wants to focus on delivering exceptional legal work while partnering closely with clients and firm leadership. The ideal candidate will have substantial experience with U.S. trademark prosecution, trademark enforcement, TTAB proceedings, and intellectual property counseling, along with a strong understanding of business law and brand protection strategies.
THE ROLE:

  • This position is designed for an attorney with at least 3 years of trademark and intellectual property experience who wants meaningful responsibility, direct client interaction, and ownership of matters from inception through resolution
  • You will manage trademark portfolios, handle TTAB proceedings, advise clients on intellectual property strategy, and work closely with business owners, entrepreneurs, and corporate clients to protect and grow their brands


KEY RESPONSIBILITIES:

  • Manage U.S. trademark matters from clearance, application preparation and prosecution through registration, maintenance, and enforcement before the United States Patent and Trademark Office (USPTO)
  • Conduct trademark clearance searches, prepare risk assessments, and advise clients on trademark prosecution and brand protection strategies
  • Respond to Office Actions and communication with the USPTO Examining Attorneys
  • Handle TTAB proceedings, including oppositions, cancellations, discovery, settlement negotiations, and appeals
  • Draft demand letters and trademark enforcement communications
  • Advise clients on intellectual property risk management, business objectives, and portfolio development, and licensing
  • Coordinate with paralegals, vendors, foreign associates, and outside counsel as needed
  • Contribute to business development initiatives and mentor junior attorneys and support staff as needed


QUALIFICATIONS:
Required Qualifications:

  • Juris Doctor (JD) from an accredited law school
  • Licensed and in good standing with at least one U.S. state bar
  • Significant experience prosecuting U.S. trademark applications before the USPTO
  • Strong legal research, writing, analytical, and communication skills
  • Ability to independently manage a substantial trademark docket
  • Experience advising clients on trademark strategy, enforcement, and risk management
  • Strong organizational skills with the ability to manage multiple matters and deadlines
  • Preferred Qualifications
  • Minimum of 3 years of trademark and intellectual property law experience
  • Experience handling TTAB proceedings, including oppositions and cancellations
  • Experience with international trademark portfolios and foreign trademark filings
  • Experience drafting and negotiating intellectual property agreements
  • Business law or transactional experience
  • Experience handling copyright, trademark disputes, or related intellectual property matters
  • Familiarity with e-commerce, online brand protection, and digital intellectual property issues
  • Interest in long-term growth within a boutique or mid-sized law firm environment
