Assistant Attorney General - Antitrust & Data Privacy

The Utah Attorney General has an immediate opening for an attorney to serve as an Assistant Attorney General in the Antitrust & Data Privacy Division. This position reports to the Division Director, working with a team of approximately six other attorneys and staff, focusing primarily on antitrust enforcement, while assisting with the data privacy docket. We are committed to serving the public, and we do this by working collaboratively with other state and federal partners in affirmative civil litigation. The work includes investigations, merger reviews, and enforcement actions in state and federal courts.

This is a limited-term position for a period of two years.

Our team has been on the front lines of litigation against large technology companies like Google, Meta, and Live Nation. Additionally, the Antitrust Team has ongoing Utah specific investigations and litigation. We also lead multistate actions against companies that have breached consumer data. For example, Utah was a leader in protecting our citizens' genetic information when 23andMe filed bankruptcy in March 2025

The Division is also at the cutting edge of the national discussion about cybersecurity, consumer data privacy rights, artificial intelligence and related topics like child online safety and privacy, and social media regulation. Utah is a leader in developing and instituting data privacy protections for consumers, and the team is responsible for enforcing the Utah Protection of Personal Information Act (UPPIA), the Utah Consumer Privacy Act (UCPA), the Genetic Information Privacy Act (GIPA), and the Government Data Privacy Act (GDPA), and more.

The ideal candidate will have experience with litigating antitrust and competition law. The candidate will also be familiar with the dynamics of multistate enforcement actions or similar multi-party cases in the private sector. The job will involve navigating complex civil investigations and litigation. All candidates should be able to manage their own caseload from initial complaints to investigation, litigation, trial, and appeal. In addition to working with many other states attorneys general, the Federal Trade Commission, and the U.S. Department of Justice, our team also advises and helps develop state legislation and policies. Some travel will be necessary.

We intend to fill this position with an attorney who has five or more years of civil litigation experience. Membership in good standing in the bar of a State of the United States is required for employment. Membership in the Utah State Bar in good standing is required within a reasonable period of time after employment. The position is in-office in Salt Lake City, Utah.

Responsibilities

ย ย ย ย  Conduct all levels of civil litigation from initial intake, through investigation, pretrial, pleadings, expert and fact discovery, trial, appeal, and post-judgment.

ย ย ย ย  Maintain an active caseload with minimal supervision.

ย ย ย ย  Coordinate with public information officer as needed.

ย ย ย ย  Build collaborative relationships with other state and federal enforcers.

ย ย ย ย  Litigate high-profile and complex cases.

ย ย ย ย  Communicate, write, and listen well.

ย ย ย ย  Draft legal briefs, contracts, and memoranda.

ย ย ย ย  Travel to various events and courts in and outside of Utah.

ย ย ย ย  Develop cases from initial complaints or inquiries.

ย ย ย ย  Additional factors that may be considered would be a formal education in economics.

Qualifications

ย ย ย  Strong knowledge of general antitrust and competition laws.

ย ย ย  Experience with performing investigations and civil litigation in federal and state court.

ย ย ย  Experience with managing a caseload with minimal supervision.

ย ย ย  Skill to perform all above responsibilities.

ย ย ย  Communicate well within a team environment.

ย ย ย ย  Strong ability to read and interpret difficult texts and sources of law.

ย ย ย  Understand complex legal processes and procedures, including multidistrict litigation.
