What is a Product Counsel?

A Product Counsel is a legal professional who advises companies on the legal aspects of developing, launching, and managing products and services. They work closely with product, engineering, marketing, and compliance teams to ensure that products meet all applicable laws and regulations, including data privacy, intellectual property, and consumer protection. Product Counsels help identify legal risks early in the product development process and provide guidance to mitigate those risks. Their role is crucial in enabling innovation while protecting the company from potential legal issues.

What is the highest paid lawyer career?

Is a counsel higher than a lawyer?

A Product Counsel is a legal professional specializing in advising companies on product-related legal issues, and their role is generally considered a specialized legal position rather than a hierarchy level. The terms 'counsel' and 'lawyer' are often used interchangeably, with 'counsel' typically referring to a lawyer working within an organization or in a specific legal capacity. The hierarchy depends on the organization, but in most cases, 'counsel' is a title indicating a legal role rather than a rank above or below a lawyer.

How does a Product Counsel typically collaborate with engineering and product teams during the product development lifecycle?

Product Counsel work closely with engineering and product teams to ensure new features and products comply with applicable laws and regulations. They are often involved early in the development process, reviewing product designs, advising on privacy and data security implications, and identifying potential legal risks. Regular cross-functional meetings and proactive communication are common, allowing Product Counsel to provide timely guidance and help teams make informed decisions. This collaborative approach not only mitigates legal risk but also supports the launch of innovative and compliant products.

What are the key skills and qualifications needed to thrive as a Product Counsel, and why are they important?

To thrive as a Product Counsel, you need a strong legal background, typically with a JD degree and bar admission, as well as experience in technology or product-related legal matters. Familiarity with contract management tools, compliance systems, and data privacy regulations (such as GDPR or CCPA) is essential. Exceptional communication, problem-solving abilities, and business acumen are standout soft skills in this role. These skills are crucial for providing practical legal guidance, mitigating risk, and ensuring product compliance while supporting innovation.

Summary:
We are seeking an experienced Product Counsel attorney to be a part of our growing Legal team. As Product Counsel, you will be an integral part of a business-oriented and collaborative Legal team with a clear focus on enabling the company's objectives. The successful candidate will be a proactive, professional, business-minded lawyer with a deep understanding of the legal and regulatory issues affecting global technology and cybersecurity SaaS companies. This role is critical to the overall success of the company and will work directly with our Product, Engineering, and R&D teams on a broad range of legal matters, providing strategic, commercial and regulatory advice throughout the entire product lifecycle, from initial product development and design to launch and post-release support.
While fully supported by the Legal team, this role requires the ability and willingness to operate independently and take initiative in a fast-paced environment with minimal supervision. Direct experience supporting software product teams and advising on a broad range of strategic, legal and regulatory matters throughout the product development and global launch cycle is required to successfully deliver on this role. Excellent judgment, strong verbal and organizational skills, and the ability to balance pragmatic solutions with appropriate legal and regulatory risk management is expected. You must also have strong interpersonal skills and the ability to collaborate with individuals at all levels of the organization in a positive, service-oriented manner.
This role will report directly to the Deputy General Counsel and can either be based out of our corporate offices in San Francisco, CA or Seattle, WA or remote (in the United States) for the right candidate.
What You'll Do:
  • Act as a trusted legal advisor and key partner to our Product, Engineering, and R&D teams, providing legal and regulatory compliance support from the initial stages of SaaS product development to global launch, helping to identify and proactively mitigate risks.
  • Conduct comprehensive legal risk assessments for new and existing products and product features, including assessing privacy, security, and intellectual property risks.
  • Advise on the legal and regulatory frameworks relevant to global cybersecurity and SaaS products, including data privacy laws (e.g., GDPR, CCPA), export control requirements, open source considerations, and evolving AI-specific legislation.
  • Draft, review, and negotiate a wide range of product-related legal documents, including vendor and integration agreements, evaluation agreements, terms of service, acceptable use policies, and privacy policies.
  • Stay current on evolving global legal and regulatory developments in the technology and cybersecurity space and help define company policies to ensure ongoing compliance.
  • Help educate and train internal business partners on legal and regulatory requirements and best practices.
  • Other duties and assignments to support internal stakeholders and enhance and improve processes for execution of the company's strategies.

What You'll Bring:
  • Juris doctorate from an accredited law school; admitted to at least one state bar in the U.S.
  • Four plus (4+) years of relevant legal experience, including experience in an in-house product counsel role (preferably supporting a high-growth SaaS/technology company); proven track record of professional excellence.
  • Strong technical understanding of SaaS platform products and the cybersecurity industry.
  • Expertise in data privacy and protection laws, including GDPR, CCPA/CPRA, export control regulations, and other global frameworks. Familiarity with intellectual property law, open-source software licensing, and AI related regulations.
  • Demonstrated experience in drafting, reviewing, and negotiating complex commercial and technology agreements.
  • Exceptional interpersonal, verbal and written communication skills, with the ability to work in a cross-functional and geographically dispersed environment with multiple stakeholders and teams.
  • Strong business judgment and the ability to provide pragmatic, business focused legal advice to both legal and non-legal audiences. Strategic thinker with ability to work independently through issues, evaluate risks and choices and make sound judgments even in face of uncertainty.
  • Proven ability to work collaboratively in a fast-paced, dynamic, and rapidly scaling global environment. Highly organized, great attention to detail, ability to work independently and adept at managing and completing several simultaneous projects in a team-oriented environment.
  • Driven self-starter with a strong ownership mentality, constantly driving work to completion, persistently and creatively devising business-friendly, pragmatic solutions that reduce risk and enhance value.
  • High degree of integrity, ethics and trust; highly professional with ability to maintain confidences.
  • Enjoys constant learning, is open to feedback and looks for opportunities for self-improvement.
