What is a probate court investigator?

Probate Court Investigators are professionals who assist the probate court by conducting investigations in cases involving guardianships, conservatorships, and certain family law matters. Their role is to gather information about the individuals involved, assess their well-being and living situations, and provide objective reports and recommendations to the court. These investigations help the judge make informed decisions regarding the care, custody, or management of estates. Investigators may interview family members, review medical and financial records, and visit homes to ensure that vulnerable individuals are protected.

What are the main challenges probate court investigators face when gathering information for guardianship or conservatorship cases?

Probate Court Investigators often encounter challenges such as locating and interviewing individuals who may be reluctant or difficult to reach, handling sensitive family dynamics, and ensuring accurate, impartial reporting. The role requires balancing empathy with objectivity, as investigators must assess the well-being of vulnerable individuals while maintaining professionalism. Additionally, they must navigate strict legal and ethical standards, often under tight deadlines, to provide thorough reports that inform court decisions.

What are the key skills and qualifications needed to thrive as a probate court investigator, and why are they important?

To thrive as a Probate Court Investigator, you need a background in social work, law, or a related field, as well as knowledge of probate laws and investigative procedures. Familiarity with case management systems, legal research databases, and court documentation tools is typically required. Strong interpersonal skills, attention to detail, and the ability to communicate complex findings clearly set outstanding investigators apart. These skills are essential for conducting thorough investigations, ensuring accurate reports, and supporting fair judicial decisions in sensitive probate matters.

  • Adise trustees on fiduciary duties, trust interpretation, and California probate code compliance.

  • Draft Heggstad petitions, petitions for instructions, and probate code 17200 petitions.

  • File petitions for appointment of conservator (person/estate), coordinate care plans/court investigator reports, and handle annual status reports.

  • Administer first-party, third-party, and pooled disability trusts, ensuring strict compliance with Medi-Cal, SSI, and public benefit requirements.

  • This is not a purely transactional or estate planning role

  • 2+ years of experience in trust and estate law, including probate court appearances

  • Must be open to handling a mixed caseload

  • Experience with trust administration, probate, conservatorship, and/or trust litigation

  • Strong legal research, writing, and oral advocacy skills

  • Experience representing fiduciaries (trustees, administrators, conservators) in probate court

  • Ability to manage a full caseload independently with minimal supervision

  • Proficiency with legal technology and case management systems

  • Independent judgement and initiative

Compensation/Benefits:
  • Base Compensation: $120,000 - $190,000

  • Performance bonuses for exceeding 1,800 annual billable hours and for case origination

  • Case origination bonuses for cases that you bring to the Firm

  • Partnership track: Consideration for profit-sharing or partnership after 3–5 years of successful performance

  • Group health insurance (employer contributes)

  • Life insurance

  • 12 paid holidays per year

  • Paid time off accrues based on tenure

  • Paid sick leave

  • Continuing education and tuition assistance

Location:
