OVERVIEW:

Summary Description

Provide paralegal support to the Legal Department on a variety of intellectual property and marketing matters. Work with in-house and outside counsel to clear new marks, graphics and product designs, set and execute the domestic and international trademark strategy, and assist with IP claims (offensive and defensive).

Provide counseling related to IP to various business teams, including the Creative, Vertical Brands (private label) and Marketing teams, related to Name / Image / Likeness, content usage rights, social media, agency relationships, photography, and talent. Provide counseling related to activations and events, including waivers, releases, IP rights and liability.

Working knowledge of design patent issues, including the ability to work with counsel to conduct design patent clearance for new private label products.

Job Duties & Responsibilities

  • Perform trademark clearances for graphic t-shirt program, product names, and omnichannel marketing initiatives.

  • Provide counseling related to product design/development in the area of design patent and trademark.

  • Provide counseling related to Name / Image / Likeness, content usage rights, social media, agency relationships, photography and talent.

  • Analyze information provided by outside counsel on trademark clearances related to domestic and international trademarks, and domain names and provide recommendation on related risks and workarounds.

  • Partner with in-house and outside counsel in maintenance of trademark portfolio (domestic and international). Gather required documentation to support trademark applications and renewals.

  • Review watch notices for possible trademark infringement. Draft and revise correspondence related to offensive and defensive IP claims (Takedowns, Trademarks, Copyright and Patents). Partner with IS team to support brand protection efforts and related tools.

  • Assist with special projects and perform other duties as assigned.
