The Commercial Services Contract Manager is responsible for: managing commercial relationships with major OEM suppliers and strategic independent suppliers, tender management, leading bid events for major service contracts, as well as contract management and negotiations. They support the entire Operations team and report to the Director, Commercial Services.
Key requirements for this position include a strong understanding of contract law and interpretation, supplier capabilities, industry best practices, renewable energy technology, and relationship management to hold our suppliers accountable and drive continuous improvement. It is necessary to excel at working cross functionally in a matrixed organization with a wide range of internal departments such as Field Operations, Remote Operations & Control Systems, Supply Chain & Logistics, Technical Services, Projects, Engineering, Permitting and Legal to identify, synthesize and meet business requirements.
This position will be responsible as well for coordinating the best practices in contractual negotiation and management with other areas in the Iberdrola Group.

Key Responsibilities
  • Train Plant Managers and the Operations team on key aspects of all contracts and settlements to enable them to act as the first level of support on any contract performance issue once the site is constructed.
  • Work with Plant Managers to ensure Service & Maintenance Agreement Availability Guarantees are closely tracked for contract compliance. Ensure any liquidated damages due are collected from the supplier in a timely manner and, if possible, apply towards O&M Fees.
  • Lead Quarterly Executive Business Reviews with major OEMs. Manage and improve supplier performance and relationships. Anticipate and resolve any quality issues or risks.
  • Lead efforts to define Service Fee Budgets as part of the annual budgeting process. Ensure contract compliance with respect to any indexing of service fees year over year. Ensure key service suppliers are paid in a timely manner for service contracts, transactional service work, and parts.
  • Lead end-of-warranty process for TSAs, ESAs, and SMAs including internal and external inspections, synthesis of claims, and claim resolution. Identify and resolve any serial defect claims.
  • Serve as escalation point for any contract performance issues. Negotiate Settlement Agreements with suppliers.
  • Assist in negotiating Turbine Supply Agreements (TSAs) and Equipment Supply Agreements (ESAs) for solar sites in key areas to support Operations interests such as warranties, spare parts support, and project completion.
  • Negotiate Service & Maintenance Agreements (SMAs) for both new and existing projects.

Tender Management: Leading bid events for major service contracts
  • Lead identification of qualified sources of supply for Services projects and Special Upgrade/Retrofit Projects.
  • In collaboration with internal stakeholders, draft and review contracts and claims.
  • Work with Operations stakeholders, including Engineering and site teams, to develop Scopes of Work for bid packages. Works with plants as required to refine requirements.
  • Work with Corporate Procurement to publish and evaluate requests for proposals consistent with Company policies.
  • Negotiate and benchmark costs with industry suppliers.
  • Ensure all relevant internal controls are followed and develop new controls as needed.

Required Qualifications
  • Bachelor's Degree or the equivalent combination of education and experience.
  • 4+ years contract drafting, interpreting, administration, and account contract management-related experience.
  • 4+ years in the areas of key responsibilities, specifically in identifying, negotiating, and managing the alignment of 3rd party objectives and goals with company objectives and needs.
  • Ability to read and interpret technical documents, drawings, and specifications.
  • Self-starter with demonstrated performance building consensus and leading cross-functional initiatives.
  • Bias for action and ability to work independently within a multinational organization.
  • Excellent analytical, project management, presentation, negotiation, and communication skills.
