Job description

Litigation Counsel – Construction Industry (Maryland)

Highland Consulting Group is a national recruiting firm specializing in placing top construction talent across the commercial and industrial sectors. We are partnering with a leading construction organization to identify an experienced Litigation Counsel with deep expertise in the construction industry.

This is a high‑visibility, in‑house legal role responsible for managing all litigation matters, including commercial, construction, and administrative claims (DEP, EHB, OSHA). The Litigation Counsel will lead mediation, arbitration, settlement negotiations, and oversee outside counsel. Candidates must hold a J.D. from an accredited law school and be licensed to practice in the State of Maryland.

Key Responsibilities

  • Review, draft, and negotiate construction‑related agreements (owner contracts, subcontracts, POs, vendor agreements).

  • Provide clear, risk‑based legal guidance to internal stakeholders on contractual obligations and risk allocation.

  • Ensure contract compliance with company standards, applicable laws, industry best practices, and insurance requirements.

  • Advise on legal issues throughout all phases of construction: bidding, execution, project completion, and closeout.

  • Provide guidance on change order disputes, delay claims, and potential risk exposures.

  • Represent or oversee representation in all commercial and construction litigation, arbitration, and bond/insurance claims.

  • Initiate and defend collection actions.

  • Manage and coordinate outside counsel.

  • Support development of the company’s business plan and strategic initiatives.

  • Advise the CEO and Board of Directors on legal matters impacting projects and operations.

  • Assist Corporate Counsel with governance, HR, and compliance matters.

Qualifications & Experience

  • J.D. from an accredited law school.

  • Licensed to practice law in Maryland.

  • Minimum 10 years of legal experience, including 5+ years representing clients in the commercial contracting or construction industry.

  • Strong background in mediation, arbitration, and trial work.

  • Ability to read and interpret construction plans, specifications, and mechanical contracting documents.

  • Experience negotiating change orders, delay claims, and complex construction disputes.

  • Excellent communication, presentation, and interpersonal skills.

  • Strong organizational skills with the ability to coordinate across multiple departments.

  • Proficiency in Microsoft Word and Excel.

  • Ability to lead, influence, and enforce corporate policies and procedures.

Compensation & Benefits

This company is committed to the well‑being of its employees and their families. The role includes a comprehensive and competitive benefits package:

  • Competitive compensation

  • Medical, dental, and vision insurance

  • 401(k) with company match

  • Life insurance, short‑term and long‑term disability

  • Discretionary annual bonus program

  • Generous PTO
