Position Summary

The Junior Pre-Litigation Attorney will manage a caseload of personal injury matters from intake through settlement or litigation referral. This role requires strong communication skills, sound judgment, attention to detail, and the ability to work collaboratively with case managers, legal assistants, demand writers, and department leadership.

The ideal candidate is someone who can effectively evaluate liability and damages, guide case strategy, communicate with clients compassionately, and push files toward timely and favorable resolution.

Key Responsibilities

Case Management & Legal Oversight

  • Manage a pre-litigation caseload from onboarding through settlement or escalation to litigation
  • Review case facts, liability, injuries, treatment progress, and damages exposure
  • Develop and implement case strategy in coordination with staff and leadership
  • Identify liability issues, insurance coverage issues, and case value considerations
  • Provide legal guidance to case managers and support staff on assigned files
  • Review medical treatment progress and determine readiness for settlement demand

Client Communication

  • Conduct attorney-client calls and maintain regular communication with clients regarding case status
  • Provide legal guidance and set expectations regarding treatment, liability, and settlement timelines
  • Handle escalated client concerns with professionalism and empathy
  • Ensure clients feel supported and informed throughout the life of the case

Demand, Negotiation & Settlement

  • Review and approve settlement demands and supporting documentation
  • Negotiate bodily injury claims with insurance adjusters
  • Evaluate settlement offers and provide strategic recommendations
  • Work to maximize settlement outcomes while maintaining file movement and client satisfaction
  • Assist with settlement approvals and resolution strategy

File Review & Case Progression

  • Conduct regular file audits to ensure cases are progressing appropriately
  • Identify stagnant files and implement corrective action plans
  • Monitor key milestones including treatment updates, policy disclosures, records, and demand readiness
  • Escalate files that may require litigation review or additional attorney involvement

Collaboration & Leadership

  • Work closely with pre-litigation staff, department leadership, and intake teams
  • Assist in training and mentoring legal assistants and case managers where needed
  • Participate in team meetings, case roundtables, and performance discussions
  • Support a culture of accountability, urgency, and excellent client care

Qualifications

  • Juris Doctor (J.D.) from an accredited law school
  • Active California Bar license in good standing
  • 1–3 years of personal injury experience preferred
  • Plaintiff-side personal injury experience strongly preferred
  • Strong negotiation and client communication skills
  • Ability to manage a high-volume caseload efficiently
  • Strong organizational skills and attention to detail
  • Ability to work in a fast-paced, team-oriented environment
  • Experience with case management systems such as Litify, Filevine, or similar is a plus
