Job description

The National Association of Mutual Insurance Companies - Insurance Company (NAMICO) has a new opportunity for a Sr. Litigation Examiner in our claims department. The Sr. Litigation Examiner is responsible for handling an inventory of Directors & Officers, Fiduciary Liability (ERISA), Insurance Company E&O, Agents E&O, and Carrier & Agency EPLI Claims.  Specific duties include, but are not limited to: initial file review, identification of coverage issues, diary, reserving, retention of defense counsel and outside investigators, ongoing review, diary, payment of service bills and final claim resolution.  Responsible for preparing loss prevention articles and/or delivering loss prevention seminars and programs as needed or assigned.


Essential functions of the position include:

  • Assumes responsibility for claim files as assigned by VP-Claims & CEO.
  • Reviews claims as to coverage under NAMICO program policy.
  • Issues Reservation of Rights letters and Coverage disclaimer letters, as appropriate.
  • Reviews claims as to liability and formulate claim resolution strategy.
  • Retains and manages defense counsel on all litigated claim files, including suit budgets, plan of action, hiring of outside investigators and/or experts, planning of discovery, and negotiation of claims.
  • Retains coverage counsel on selected files to assist in determining NAMICO's coverage position.
  • Maintains diary on all assigned claims.
  • Establishes, monitors, and changes claim reserves as appropriate.
  • Reviews and evaluates files on an ongoing basis and revises claim resolution strategy, as required.
  • Keeps senior management apprised of the status of all claims involving large loss reserves or proposed indemnity payments.
  • Meets with appropriate parties, attend mediations, arbitrations, and trials.
  • Resolves claims within authority, or obtains required authority from VP-Claims & CEO.
  • Prepares Loss Prevention or Claim Description articles for NAMICO/NIA publications on an as needed basis.
  • Presents Loss Prevention Seminars at various state and association meetings as needed.
  • Assists in marketing of applicable products and training seminars.
  • Consults with underwriters on risk selection and policy revisions, as well as assist underwriters with coverage questions.
  • Builds and maintains positive work relationships with management, staff members, and external contacts.
  • Arrives to work on time and maintains a positive attendance record.
  • Performs any other duties and projects as assigned.

Qualifications include:

  • Minimum of 5 years experience in personal lines insurance (property or liability) and/or commercial insurance lines (property or liability) claim handling.
  • Experience in litigation management and/or professional liability claims.
  • Ability to travel out of state regularly and occasionally to Canada.
  • Juris Doctor preferred.
  • Licensing in States where required securing reciprocal licenses when available.
  • Insurance certification/designations are encouraged.
  • Familiarity of insurance contracts and industry trends.
  • Strong knowledge of tort law, contract law and liability concepts applicable to Professional Liability claims.
  • Background in claims adjusting with litigation management experience.
  • Effective public speaking skills on as needed basis.
  • In-depth knowledge of liability policy language and coverage interpretation.
  • Must have the ability to get a valid passport.
  • Ability to successfully pass a criminal background check and must possess an acceptable MVR.
