Udaap information

What is UDAAP and why is it important in the financial industry?

UDAAP stands for Unfair, Deceptive, or Abusive Acts or Practices. These are standards set by regulatory agencies, such as the Consumer Financial Protection Bureau (CFPB), to protect consumers from harmful behaviors by financial institutions. UDAAP regulations are crucial because they ensure that consumers are treated fairly, that products and services are transparent, and that companies do not engage in practices that could exploit or mislead customers. Compliance with UDAAP helps organizations avoid legal penalties and maintain trust with consumers.

What are some common challenges faced by professionals working in UDAAP compliance roles?

Professionals in UDAP compliance roles often navigate the challenge of interpreting broad and evolving regulations to ensure their organization avoids practices that could be deemed unfair or deceptive. They must stay updated on regulatory guidance and enforcement actions, which can shift with changes in laws or regulatory priorities. Collaboration with legal, risk, and business units is crucial to proactively identify and mitigate potential compliance issues. Additionally, UDAP specialists often educate employees across departments, ensuring consistent understanding and application of policies throughout the organization.

What are the key skills and qualifications needed to thrive as a UDAAP compliance specialist?

To thrive as a UDAAP Compliance Specialist, you need a deep understanding of consumer protection laws, risk assessment, and regulatory compliance, often supported by a degree in law, finance, or a related field. Familiarity with compliance management systems, regulatory research tools, and certifications like Certified Regulatory Compliance Manager (CRCM) is highly valuable. Strong analytical thinking, attention to detail, and effective communication skills help you interpret regulations and educate stakeholders. These skills ensure organizations remain compliant, avoid legal penalties, and uphold fair treatment for consumers.

Job description

You will help ensure that our consumer lending products (mortgage, HELOC, secured/unsecured credit cards, etc.) comply with federal and state regulations, internal policies, our bank partner's requirements and reporting, and industry best practices. That requires creativity and a problem-solving orientation, because we're trying new things and working fast. You'll use your legal experience and training to interpret laws, draft and review agreements and disclosures, policies, resolve litigation matters and disputes, and advise on risk. The L&C team is hands-on wherever needed, including marketing reviews, audits, exam responses, licensing applications and reports, vendor management, statutory and regulatory analysis, contract review and drafting, and training, and we share all work regardless of experience. You'll be part of a highly valued team and work on a variety of projects across the company.
More about the role and the team: It's a small team (4 lawyers) within a flat organization. We're looking for a very capable attorney who has good foundational knowledge and experience and is ready to level up -- someone comfortable with and eager to learn more about navigating in the gray.
Responsibilities
  • Assist in ensuring compliance with TILA, RESPA, ECOA, HMDA, FCRA, UDAAP, HMDA, TRID, and other federal and state consumer lending regulations.
  • Monitor compliance with state-specific lending laws (e.g., usury laws, servicing, licensing requirements, foreclosure processes).
  • Support the development and maintenance of compliance policies, procedures, and training materials.
  • Assist in conducting compliance reviews of loan origination, underwriting, and servicing processes.
  • Perform periodic audits of required disclosures, adverse action notices, loan documents, etc.
  • Assist in responding to customer complaints, regulatory inquiries, and internal situations.
  • Research federal and state regulatory updates impacting consumer lending.
  • Assist in updating policies and procedures to reflect new laws and regulations.
  • Support compliance training efforts for internal teams.
  • Collaborate with product and engineering teams to ensure compliance is embedded in loan servicing and creation.
  • Review marketing materials and loan disclosures for Regulation Z and UDAAP compliance.
  • Assist in third-party vendor risk assessments, particularly for loan origination systems, credit reporting agencies, and payment processors.

Qualifications
  • Education: Juris Doctorate
  • Experience: 7+ years practicing law, with at least 3 recent years focused on consumer finance regulatory work; in-house experience with a fintech, bank, or mortgage company is a significant plus
  • Knowledge: Strong familiarity with applicable secured lending, marketing, and servicing laws
  • Technical Skills: Ability to work with compliance monitoring tools, regulatory databases, and task systems (e.g., Asana)
  • Other Skills: Strong attention to detail, analytical thinking, creative problem solving, and strong communication skills (verbal and written)
  • Additional things we're looking for
  • Located in Northern California - strong remote candidates considered, but preference given to candidates who can be in the office often
