Standard Job Description
The Assistant General Counsel, Intellectual Property for Data Rights will provide data rights-related advice and legal support to all Lockheed Martin Corporation Business Areas and will have responsibility for one or more lines of business within the Lockheed Martin Rotary and Mission Systems (RMS) Business Area. The successful candidate will create and provide guidance for all business areas on a comprehensive, OneLM approach to protecting the company's technical data and software in performance of U.S. Government contracts and must provide timely, accurate, and consistent intellectual property legal advice to enable the RMS lines of business to achieve business goals while maintaining an acceptable level of business risk. The person filling this position will provide a wide range of intellectual property legal support and advice regarding a full spectrum of legal issues involving intellectual property related to commercial, international and government contracts and subcontracts, intellectual property litigation, patent, copyright, or trademark matters including patentability of inventions, discovery, infringement of patents or copyrights, validity of trademarks. The successful candidate will work with key business leaders, including program personnel, and will be responsible for drafting and negotiating prime and subcontract intellectual property terms and conditions, non-disclosure agreements, complex intellectual property agreements, complex intellectual property rights provisions in teaming and other business agreements, and protection of data rights. Must have excellent analytical, verbal, and written communication skills, with an emphasis on attention to detail and a demonstrated ability to work effectively with multidisciplinary teams and a strong personal and work ethic. Will be required to secure a top secret government security clearance. Undergraduate and law school, JD or LLB, degrees required. Must be admitted to practice law by one or more states and be admitted to practice before the US Patent & Trademark Office.
This position reports to the Director and Chief Intellectual Property Counsel for Data Rights and RMS.
Key Responsibilities:
  • Assist with the creation, implementation, and advise all business areas on a comprehensive, OneLM approach to protecting the company's technical data and computer software delivered to the U.S. Government while supporting business transactions and managing risk
  • Serve as the primary point of contact (POC) for one or more Lines of Business within the RMS business area and advise management on IP-related legal issues, including government contracts, commercial transactions, mergers and acquisitions, emerging issues (e.g., artificial intelligence), and IP litigation.
  • Interface with one or more RMS lines of business and customer executives, influencing and collaborating with RMS program counsel in a team environment
  • Ensure compliance with government contract law, Federal Acquisition Regulation, and relevant clauses (e.g., patent, technical data, and software rights)
  • Apply business acumen, analytical, and problem-solving skills to manage risk and resolve
    complex IP issues
  • Demonstrate reliability, sound judgment, and a proactive approach to addressing IP challenges

Basic Qualifications
  • Minimum 10 years of relevant experience in intellectual property law, including data rights
  • JD or LLB is required, and candidate must be admitted to practice before the US Patent & Trademark Office and to practice law by one or more state bars
  • Significant experience in and fundamental understanding of copyright law and trade secret law
  • Experience in and fundamental understanding of government contract law and the Federal Acquisition Regulation and clauses
  • Thorough understanding of IP-related clauses in government contracts, the Federal Acquisition Regulation, and the Defense Federal Acquisition Regulation Supplement, specifically, patent, technical data, and software rights
  • Must have excellent writing and oral communication skills, with emphasis on attention to detail
  • Ability to easily interface with and influence corporate and customer executives and collaborate with program counsel in a team environment
  • Ability to obtain and maintain a DoD Top Secret clearance

  • Experience in and fundamental understanding of intellectual property law, including commercial and international IP transactions, intellectual property litigation, software licenses, copyright law, and trademark law
  • Experience in designing and executing IP Strategies for new and existing programs, both for commercial and sovereign customers

GeoZone Definition: GeoZones are geographic groupings created by Lockheed Martin to align compensation ranges with regional labor markets and cost-of-labor differences across the United States. Locations are assigned a Geo Zone based on the primary work location of the role.
  • Full-time salary range (GEOZONE 1): $228100.00 - $423700.00
    • Includes metropolitan areas such as Sunnyvale CA; Pal Alto, CA; New York City metropolitan area; Newark, New Jersey; etc.
  • Full-time salary range (GEOZONE 2): :$205300.00 - $381300.00
    • Includes metropolitan areas such as Denver, CO; King of Prussia, PA; Stratford, CT; Moorestown, NJ; etc.
  • Full-time salary range (GEOZONE 3): :$182500.00 - $338900.00
    • Includes metropolitan areas such as Dallas-Fort Worth, TX; Orlando, FL; Grand Prairie, TX; Marietta, GA; etc.
  • Full-time salary range (GEOZONE 4): :$164200.00 - $305000.00

  • For (Washington state applicants only) Non-represented full-time employees: accrue at least 10 hours per month of Paid Time Off (PTO) to be used for incidental absences and other reasons; receive at least 90 hours for holidays. Represented full time employees accrue 6.67 hours of Vacation per month; accrue up to 52 hours of sick leave annually; receive at least 96 hours for holidays. PTO, Vacation, sick leave, and holiday hours are prorated based on start date during the calendar year.
