Cancellation Policy: 1/2024: Client Affiliate has the right to cancel 48 hours per 13 week contract, at any time, without penalty that will not be included in the guaranteed hours. This may be full or partial shifts/hours adding up to 48 hours per 13 week contract regardless of the length of shift scheduled. 10/16/23: Cancellations by Client Affiliate of a confirmed travel or Local Contract Clinical Staff assignment shall be permitted with 2 weeks' notice prior to the anticipated start date without monetary penalty to Client Affiliate. Client Affiliate may also cancel currently contracted travel or Local Contract Clinical Staff following assignment commencement (i) immediately upon notice for cause, without monetary penalty to Client Affiliate; (ii) immediately upon notice without cause for a $1000 fee of such travel or Local Contract Clinical Staff payable to HealthTrust; or (iii) with 2 weeks' notice without cause, without monetary penalty to Client Affiliate. All travel or Local Contract Clinical Staff shall work the length of the assigned contract, not by the number of total hours worked. Cancellations by Subcontractor of a confirmed travel or Local Contract Clinical Staff assignment shall be permitted with 2 weeks' notice prior to the anticipated start date without monetary penalty to Subcontractor. Subcontractor may also cancel currently contracted travel or Local Contract Clinical Staff following assignment commencement with 2 weeks' notice without cause, without monetary penalty to Subcontractor, provided that travel or Local Contract Clinical Staff completes such 2 week period in its entirety. If travel or Local Contract Clinical Staff does not complete the entire contract by weeks worked or if cancellation by Subcontractor or travel or Local Contract Clinical Staff occurs within 2 weeks of start date, excluding hardship, HealthTrust shall credit Client Affiliate a $1000 cancellation fee. 10/16/23: Late Cancellation of Shift by HealthTrust: Cancelled more than 2 hours prior to shift for per diem Clinical Staff โ€“ no charge. Cancelled 2 hours or less prior to shift for per diem Clinical Staff โ€“ pay 2 hours at regular weekday rate to Subcontractor. Hours will not be included when calculating overtime. Cancelled during a shift for per diem Clinical Staff โ€“ pay Subcontractor for the greater of the number of hours worked or 4 hours. Late Cancellation of Shift by Subcontractor: Cancelled more than 2 hours prior to shift for per diem Clinical Staffโ€“ no charge. Cancelled 2 hours or less prior to shift for per diem Clinical Staff โ€“ charge 2 hours to Subcontractor 4. No Show by Subcontractor Staff: charge 2 hours to Subcontractor. Late Call (as determined by HealthTrust): Hours will be paid from the shift start time as long as Clinical Staff arrives within 3 hours of shift start time. Late Call will only be paid with prior approval of Client Affiliate. Hours will be paid at the regular weekday rate and will not be included when calculating overtime. 6/23: Client Affiliate may cancel 4 shifts, at any time, per 13 week contract without penalty that will not be included in the guaranteed hours. 2.11 Cancellation. 2.11.1 Per diem Clinical Staff. Cancellation by Client Affiliate of a scheduled per diem Clinical Staff shift shall be communicated to Subcontractor a minimum of 2 hours before the scheduled time of the shift. Cancellation by Client Affiliate after the 2 hour deadline will result in a 2 hour payment to Subcontractor at the applicable regular weekday rate. Cancellation by the Subcontractor of a scheduled shift shall be a minimum of 2 hours before the scheduled time of the shift. Cancellation by Subcontractor after the 2 hour deadline will result in a 2 hour credit to Subcontractor at the regular weekday rate. If per diem Clinical Staff are cancelled during a shift, Subcontractor shall be paid for the greater of the number of hours actually worked or 4 hours. 2.11.2 Travel Clinical Staff. Cancellations by Client Affiliate of a confirmed travel Clinical Staff assignment shall be permitted with 2 weeks' notice prior to the anticipated start date without monetary penalty to Client Affiliate. Client Affiliate may also cancel currently contracted travel Clinical Staff following assignment commencement (i) immediately upon notice for cause, without monetary penalty to Client Affiliate; (ii) immediately upon notice without cause, with a fee equal to the dollar value of 2 weeks of such travel Clinical Staff's guaranteed hours payable to Subcontractor; or (iii) with 2 weeks' notice without cause, without monetary penalty to Client Affiliate. Subcontractor shall pay travel Clinical Staff the wages such travel Clinical Staff would have received in the event of cancellation subject to 2.11.2(ii) above. All travel Clinical Staff shall work the length of the assigned contract, not by the number of total hours worked. If travel Clinical Staff does not complete the entire contract by weeks worked or if cancellation by Subcontractor or travel Clinical Staff occurs within 2 weeks of start date, excluding hardship, Subcontractor shall pay Client Affiliate (or Client Affiliate may deduct from other amounts payable to Subcontractor, in Client Affiliate's discretion) a $750 cancellation fee. 2.11.3 Allied Clinical Staff. Cancellation by Client Affiliate of a scheduled allied Clinical Staff shift shall be communicated to Subcontractor by 12pm Client Affiliate time the day prior to start of the scheduled shift. Cancellation by Client Affiliate after the deadline will result in a 2 hour payment to Subcontractor at the applicable regular weekday rate. Cancellation by the Subcontractor of a scheduled shift shall be communicated to Client Affiliate by 12pm Client Affiliate time the day prior to start of the scheduled shift. Cancellation by Subcontractor after the deadline will result in a 2 hour credit to Client Affiliate at the regular weekday rate. If allied Clinical Staff are cancelled during a shift, Subcontractor shall be paid for the greater of the number of hours actually worked or 4 hours.
