Commercial Title Underwriter / Attorney

Position Summary
  • The Commercial Title Underwriter / Attorney is responsible for underwriting complex commercial real estate transactions across multiple jurisdictions, evaluating title risk, and
  • providing legal analysis and guidance, in accordance with company guidelines and applicable state laws. The Commercial Title Underwriter / Attorney will partner with internal teams and
  • collaborate with external stakeholders. This role helps facilitate successful commercial real estate closings while ensuring compliance and appropriately managing risk.
Essential Duties and Responsibilities
Underwriting Responsibilities
  • Review and analyze title examinations, surveys, organizational documents, and other transaction-related materials for commercial real estate transactions.
  • Evaluate and assess title risks, defects, encumbrances, and insurability issues.
  • Structure underwriting solutions and provide guidance regarding curative actions required to resolve title matters.
  • Determine appropriate title insurance coverage, endorsements, exceptions, and underwriting requirements.
  • Collaborate with agents, escrow officers, title examiners, other underwriters, and closing teams to ensure accurate and timely transaction processing.
  • Review and approve complex commercial transactions involving acquisitions, development projects, refinances, construction loans, portfolio transactions, multi-state and multi-site properties.
  • Maintain compliance with underwriting standards, regulatory requirements, and company risk management policies.

Other Advisory Responsibilities
  • Provide legal analysis and advise internal teams on title, real estate, corporate, and transactional matters.
  • Review and interpret purchase agreements, loan documents, leases, easements, restrictive covenants, and other real estate-related documents.
  • Assist in the resolution of title claims, disputes, and curative matters.
  • Research applicable laws and regulations to support the development of underwriting policies, procedures, and best practices. Prepare materials and deliver presentations for internal and external training
Business Development and Relationship Management
  • Develop and maintain strong relationships with attorneys, lenders, developers, investors, brokers, and other commercial real estate professionals.
  • Serve as a trusted advisor and subject matter expert for commercial title and underwriting matters.
  • Participate in client meetings, industry events, and educational presentations.
Qualifications
Education
Juris Doctor (J.D.) degree from an accredited law school.
Active license to practice law.
Experience
  • Minimum of 5-10 years of experience in commercial title underwriting, commercial real estate law, commercial title insurance, or a related field.
  • Demonstrated experience underwriting and/or closing complex commercial real estate transactions across the United States.
  • Strong understanding of title insurance policies, endorsements, underwriting guidelines, and real estate transaction structures.
  • Knowledge, Skills, and Abilities Extensive knowledge of commercial real estate transactions, title insurance, and underwriting practices.
  • Strong legal research, legal writing, analytical, and problem-solving skills.
  • Ability to identify, assess, and mitigate title and transactional risks.
  • Excellent written and verbal communication skills.
  • Strong organizational and project management abilities with attention to detail.
  • Ability to manage multiple transactions and priorities in a fast-paced environment.
  • Proficiency with title production systems, underwriting platforms, and Microsoft Office applications.

Preferred Qualifications
  • National Commercial Services (NCS) experience.
  • Experience with multi-state transactions and large portfolio deals.
  • Existing relationships within the commercial real estate, lending, legal, and development communities.
  • Experience mentoring other underwriters and title operations staff.
Physical Requirements
  • Ability to work in an office and use standard office equipment.
  • Ability to timely respond to business needs outside of normal business hours, including remote access by phone or computer, as required Ability to attend client meetings, industry events, and occasional travel as required.
