What does a patent litigation associate do?

A Patent Litigation Associate is a lawyer who specializes in handling legal disputes involving patents. They work with clients to enforce or defend patent rights in court, draft legal documents, conduct research on patent laws and prior art, and assist in all stages of litigation from pre-trial investigations to trial and appeals. These associates collaborate with inventors, experts, and other attorneys to build strong cases and protect intellectual property. Their work requires a solid understanding of both law and technology.

What are the key skills and qualifications needed to thrive as a patent litigation associate?

To thrive as a Patent Litigation Associate, you need a strong background in intellectual property law, excellent legal research and writing skills, and typically a J.D. degree with bar admission. Familiarity with legal research databases like Westlaw or LexisNexis, case management software, and sometimes a technical or scientific background are important assets. Strong analytical thinking, attention to detail, and effective communication with clients and teams distinguish top performers. These skills ensure precise case strategy, efficient case management, and successful advocacy in complex patent disputes.

Job description

About Latham & Watkins
Latham & Watkins is one of the world's leading global law firms advising the businesses and institutions that drive the global economy. We are the market leaders in major financial and business centers globally and offer unmatched expertise and resources to help you grow from an intellectually curious self-starter into an exceptional lawyer. If you aspire to be the best, this is where you belong.
About the Practice Group
We are trial lawyers who draw on deep technical knowledge, industry insight, and experience litigating across venues to protect our clients' intellectual property, preserve value, and win precedent-setting victories in every type of dispute.
Our team of more than 100 IP litigators brings trial-tested experience to matters ranging from cutting-edge pharmaceutical and technology patent disputes to the copyright, trademark, and trade secrets cases that reshape industries. We can tailor our teams to match our specific capabilities with each client's specific needs - no matter the IP at issue. We can also address any combination of IP and related antitrust, contract, and unfair business practices claims.
Adversaries know we win the most complex and high-profile IP matters across the spectrum of district courts and the Federal Circuit, as well as at the International Trade Commission (ITC) and Patent Trial and Appeal Board (PTAB). Our reputation often leads us to take over high-stakes IP cases mid-way, securing victories for clients who had faced long odds. Our appearance on the docket signals to opposing counsel that our client is willing to take the case to trial to win.
About the Role
The Litigation & Trial Department seeks a skilled and highly qualified associate with a minimum of three years of patent litigation experience to join its rapidly expanding practice. The ideal candidate will have an undergraduate and/or advanced degree in engineering, computer science, chemistry, biology, physics, or a similar field.
