The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the state, state agencies, and elected officials, and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally, the Department of Justice includes the North Carolina State Crime Lab, the North Carolina Justice Academy, and the Sheriffs’ and Criminal Justice Education and Training Standards Divisions.

This position will be responsible for setting the tone and providing leadership and management for the Section. The Section provides a full range of legal services, including litigation before State and federal tribunals, to a number of State agencies or agency components, including the Administrative Office of the Courts, the Department of State Treasurer, the Office of State Human Resources and its commission, the Department of Natural and Cultural Resources, the Credit Union Division, the Department of Information Technology and its boards and commissions, the Lottery and its commission, the Office of the Commissioner of Banks and its commission, the Office of State Controller, and the Wildlife Resources Commission. The Section also provides legal services to a number of occupational licensing boards and commissions. This position coordinates and supervises the work of a Section which is comprised of one attorney supervisor, sixteen attorneys, two paralegals, and two support staff members.

Because most of the attorneys in the Section represent different clients, with varying missions and goals, the individual in this position must possess a wide array of subject matter expertise, including the enforcement and regulatory rights of different State agencies, boards and commissions, public records laws, open meeting laws, Chapter 93B - Occupational Licensing Boards, Chapter 150B - Administrative Procedures Act, Ethics Act, Chapter 143 - Defense of State Employees, and State contracting terms and conditions and processes. Additionally, since the Services to State Agencies’ attorneys work on many complex cases this position must be thoroughly familiar with complex litigation processes and procedures and collaborate well with other positions at DOJ, including the Civil Division Head, the Civil Bureau Chief, members of the Solicitor General and General Counsel’s Offices and other attorneys and work groups throughout the legal services division.

This attorney handles the following administrative responsibilities: approving time in Beacon; monthly updating the DOJ Tracker; providing monthly highlights of work completed in the Section; compiling information for the DOJ annual report; compiling information for legislative reports submitted by DOJ; reviewing and approving travel expenses and other costs and expenses; updating job descriptions; and, maintaining the cooperative agreements between State agencies, boards and commissions and DOJ.

The attorney in this position must exercise substantial discretion and make quick, independent decisions when appropriate, but also recognize when matters need to involve the Division Head and others within DOJ, including the Civil Bureau Chief, Solicitor General’s Office and the General Counsel’s Office. Additionally, the attorney in this position must be able to work effectively with individuals outside of DOJ, including high-level State officials in a complex, constantly changing environment. This position provides direct representation to the Office of the State Controller. This position also provides oversight to the legal services provided to the various State agencies, boards and commissions represented by the Section, including weighing in on trial and settlement strategies. This position is an excellent opportunity for an experienced civil litigator with management skills who has ability to promptly make management and legal strategy decisions and execute on those decisions.

Knowledge, Skills and Abilities / Management Preferences

• Submit one writing sample no more than 20 pages, preferably a civil trial or appellate brief or memorandum, that you independently authored.

Minimum Education and Experience

• Licensed to practice law by the North Carolina State Bar and five years of progressively responsible professional legal experience.
• Credit for foreign degrees will only be given if verification of degree certification is attached to your application. Transcripts for foreign degrees have to be evaluated by an organization like World Education Services to determine US equivalency.
