Wage & Hour Attorneys is a plaintiff-side litigation firm with offices in New York, Philadelphia, Miami, New Jersey, Los Angeles, and San Francisco. We represent workers across the country in cases involving unpaid overtime, minimum wage violations, employee misclassification, off-the-clock work, stolen tips, unpaid commissions, and class and collective actions. The Role
We are seeking a motivated and detail-oriented Associate Attorney to join our litigation team. This is a substantive, hands-on litigation role. You will be responsible for working up wage and hour cases from intake through trial-ready preparation, under the supervision of the firm's Managing Partner. While you will not sit lead chair at trial, you will be expected to own every phase of the case before that point, and to be fully prepared to support trial proceedings.

What You'll Do
โ€ข Evaluate and screen new client intakes; conduct client interviews and initial case assessments
โ€ข Draft and respond to pleadings, discovery requests, motions, and briefs
โ€ข Manage all phases of discovery, including written discovery, document review, and depositions.ย 
โ€ข Conduct legal research on federal and state wage and hour law, with a focus on FLSA and applicable state statutes across the firm's jurisdictions
โ€ข Draft demand letters, mediation submissions, and settlement agreements
โ€ข Assist in the development and prosecution of class and collective action matters, including conditional and final certification briefing
โ€ข Communicate directly with clients, opposing counsel, and court staff
โ€ข Work collaboratively with the Managing Partner to develop litigation strategy and prepare cases for trial
โ€ข Stay current on evolving FLSA regulations, state wage laws, and relevant case law

What We're Looking For
โ€ข J.D. from an accredited law school; active bar admission required (NY, NJ, PA, FL, or CA preferred)
โ€ข 2โ€“5 years of litigation experience; wage and hour experience strongly preferred, plaintiff-side employment law experience a plus as wellย 
โ€ข Solid working knowledge of the Fair Labor Standards Act (FLSA) and state-specific wage and hour laws, including but not limited to New York Labor Law, New Jersey Wage Payment Law, Pennsylvania Minimum Wage Act, California Labor Code, and Florida wage statutes
โ€ข Familiarity with class action and FLSA collective action procedures under Rule 23 and 29 U.S.C. ยง 216(b)
โ€ข Strong legal research and writing skills; ability to draft clear, persuasive briefs and motions
โ€ข Highly organized, self-directed, and capable of managing multiple active files simultaneously
โ€ข Commitment to representing workers and a genuine interest in employee-side advocacy

โ€ข Experience with PAGA claims (California) or other state-specific representative action procedures
โ€ข Familiarity with DOL investigation procedures and administrative wage claims
โ€ข Bilingual (Spanish/English) a plus given our client base

What We Offer
โ€ข Competitive compensation - ย $100K per year for the first year while you develop your caseload, and then your salary will switch to 1/3 of the firm's attorneys fees like all of our attorneys who, generally, make much more than that. Also, while we do not provide health insurance through the firm, after 6 months we reimburse 50% of the cost of your premium up to $450. You will receive a 401k safe harbor after one year.ย
