Job description

Summary

Provide legal advice and representation to MCW regarding a variety of legal matters in higher education, research, health care, and community service. Job emphasis will include contractual matters and research operations of MCW.

Primary Responsibilities
  • Provide legal guidance on research issues including federal and Wisconsin laws relating to clinical trials and IRB, compliance with federal research regulations and guidelines, advising on data sharing and HIPAA privacy and security issues, bioethics, human and animal subject protections, industry collaborations, scientific misconduct, material transfer agreements, and corporate compliance. Have an understanding of global laws impacting research operations, including GDPR and export control laws.
  • Review, draft, negotiate and manage a variety of contract and business matters relating to transactions with clinical partners, including such items as professional service agreements, medical director contracts, and related clinical affiliation agreements. Must have knowledge of fraud and abuse laws and billing and reimbursement.
  • Provides key legal support to the Purchasing/Procurement office including review of contracts related to new business, procurement and general operations. Advise on matters relating to insurance, indemnification and limitation of liability.
  • Advise philanthropy operation on legal matters relating to charitable giving, sponsorship, building naming agreements or other philanthropic specific agreements;
  • Provide legal advice on intellectual property matters including trademark, copyright, trade secrets and possible infringement. Serve as resource on brand and marketing matters. Advise on fair use questions. Draft legal documents including confidentiality and non-disclosure agreements.
  • Advises on legislative and other important legal developments that could affect MCW and its operations; performs research and drafts policies and legal documents; and provides opinions on a broad range of legal matters.
  • Deals regularly with officers, senior associate deans and department chairs of the organization, faculty, and top-level management officials and senior attorneys in other organizations.
  • Carries out assignments independently and makes final legal determination in matters of substantial impact.

  • Law & Government - Knowledge of laws, legal codes, procedures, state and federal regulations, executive orders, and political processes
  • Complex problem solving and problem sensitivity - Skilled at identifying and anticipating legal risks and selecting the best course of action to deter legal complications
  • Communication - Ability to effectively communicate complex ideas verbally and in writing in language that others understand by using legal jargon as needed and appropriate for diverse audiences
  • Administration & Management - Knowledge of business principles to effectively plan, allocation of resources, and coordinate strategic and tactical objectives
  • Tools & Technology - Knowledge of, and ability to proficiently use, Microsoft Office Suite and standard office equipment.
Qualifications
  • Appropriate experience may be substituted for education an on equivalent basis.
  • Minimum Required Education: Juris Doctor from accredited law school
  • Minimum Required Experience: 10 years, in house counsel experience required
  • Preferred Experience: Academic medical center experience preferred
  • Preferred Certification / Licensure(s ): Wisconsin bar admission within one year for an attorney admitted to practice in any other state or territory or the District of Columbia

Work requires occasionally lifting moderate weight materials, standing, or walking continuously.

Work Environment

Occasional exposure to dust, noise, temperature changes, or contact with water or other liquids. Work is performed in an environmentally controlled environment.

Sensory Acuity

Ability to detect and translate speech or other communication required . May occasionally require the ability to distinguish colors and perceive relative distances between objects.
