The Senior Corporate Counsel, Marketing and Product, is an experienced and critical legal advisor at CarMax, Inc. (NYSE: KMX), a leading auto retailer and one of the Fortune 100 Best Companies to Work For. In this role, you will provide legal counsel and general business legal support in a fast-paced and dynamic environment, with your primary focus on marketing matters and guiding marketing-related product teams Specifically, you will advise marketing and product teams on legal obligations and risks, and counsel teams on new or emerging legal requirements to enable execution and innovation, while proactively managing risk, optimizing business practices, and implementing necessary changes. You will assist in the management of pre-litigation and regulatory marketing matters including unfair competition, false advertising, and violations of state and federal telemarketing and email marketing laws. You will report to the Assistant Vice President of our Corporate and Operations Legal Advisors team.
What you will do - Essential Responsibilities
  • Provide lead legal counsel and risk management advice regarding compliance with all state and federal marketing laws, regulations, and industry regulatory guidelines affecting used vehicle retail and wholesale operations, and specifically regarding unfair and deceptive acts and practices ("UDAP") law, antitrust law, sweepstakes and sponsorships, and marketing privacy law.
  • Analyze CarMax's online, broadcast, carmax.com, app, social, and other media advertising and provide advice on advertising issues, including disclaimers, disclosures, and claims substantiation.
  • Collaborate with marketing, operations, and other legal team members on cross-functional projects and new and existing innovations, products, services, strategic partnerships, sports sponsorships, and the related marketing strategies and initiatives.
  • Provide support to the commercial transactions team regarding the legal requirements associated with marketing and advertising contracts, such as licensing agreements, sponsorship agreements (including sports sponsorships), influencer agreements, agency agreements, and third-party listings.
  • Provide substantive support to CarMax's Compliance Services in the areas of unfair and deceptive acts and practices ("UDAP") law, antitrust law, sweepstakes and sponsorships, and marketing privacy.
  • Provide substantive support on the development and maintenance of company trademarks and other intellectual property.
  • Analyze new and existing federal and state laws and regulations and provide substantive support to the Government Affairs team, including the analysis of proposed and pending legislation and regulation and advise and collaborate with the business and other Legal team members on recommended business changes.
  • Manage special projects as assigned.

Qualifications and Requirements
To perform this job successfully, an individual must be able to perform each essential duty satisfactorily. The requirements listed below are representative of the knowledge, skill, and/or ability required.
Law degree.
  • Member in good standing with the bar of a U.S. jurisdiction.
  • Minimum 8 years of relevant legal experience
  • Experience advising clients on the development and marketing of consumer products in a regulated industry, ideally in the automotive industry.
  • Excellent written and verbal communication skills to effectively communicate legal developments and advice to associates, all levels of management, outside counsel, opposing counsel, and regulatory authorities.
  • Excellent analytical, reasoning, and problem-solving skills required in connection with researching and analyzing the law, assessing impact on business processes, and making recommendations to business units to effectively manage legal and operational risks.
  • Strong interpersonal and leadership skills required to collaborate and advise other legal team members and internal and external clients.
  • Ability to understand basic business reports and analyses.

Work Location and Arrangement: This role will be based out of the CarMax Home Office in Richmond, VA Associates based in Richmond work onsite 4 days per week.
Work Authorization: Applicants must be currently authorized to work in the United States on a full-time basis. Sponsorship will not be considered for this specific role.

The annual salary for this position is:
$165,400.00 - $264,600.00
May be eligible for bonus and equity.
Benefits:
Except as otherwise required by state law, CarMax Associates are entitled to the following paid sick, vacation, and holiday time.
Associates that are considered full-time hourly or commission/incentive eligible:
  • To earn up to 48 hours of sick time per year accrued on a per pay period basis and between 80 hours and 200 hours per year of vacation time after a 90 day waiting period depending on years of continuous service with the Company.
  • For 8 hours of pay for each of a total of 6 paid scheduled holidays per year plus 1 floating holiday. If such an Associate does work on a scheduled holiday due to business need, they are eligible for Holiday Premium Pay.

Associates considered full-time salaried are entitled to paid time away with no specified limit as needed for sick, vacation, bereavement, jury duty, holidays, floating holiday, etc. subject to manager approval.
