Litigated Claims information

What are litigated claims?

Litigated claims refer to insurance claims or legal disputes that have proceeded to formal litigation, meaning they are being resolved through the court system rather than through negotiation or settlement outside of court. This typically happens when parties cannot agree on liability or the amount of compensation. Litigated claims often involve attorneys, legal filings, and potentially a trial, making the process more complex and time-consuming compared to non-litigated claims. Handling litigated claims requires a thorough understanding of legal procedures and strong negotiation skills.

What are common challenges faced by professionals handling litigated claims, and how can they effectively manage them?

Professionals managing litigated claims often encounter challenges such as managing large volumes of complex documentation, meeting tight court deadlines, and coordinating with multiple stakeholders including attorneys, clients, and experts. Effective management relies on strong organizational skills, clear communication, and the ability to prioritize tasks under pressure. Utilizing case management software and developing efficient workflows can also help in tracking important dates and ensuring thorough preparation for hearings and depositions.

What are the key skills and qualifications needed to thrive as a litigated claims adjuster, and why are they important?

To thrive as a Litigated Claims Adjuster, you need a solid understanding of insurance policies, legal principles, and claims investigation, often supported by a bachelor's degree in a relevant field and experience in claims handling. Familiarity with claims management systems, legal research tools, and sometimes certifications like the Associate in Claims (AIC) are commonly required. Strong negotiation, analytical thinking, and effective communication skills help resolve disputes and collaborate with attorneys and stakeholders. These skills ensure accurate assessment, fair resolution, and effective management of complex litigated claims.
