IP Associate - Patent Prosecution

Location: Charlotte, NC OR Atlanta, GA

Salary: $150k-$210k/yr
Position Overview
We are seeking an IP Associate specializing in patent prosecution to join our intellectual property team. The successful candidate will manage patent portfolios, draft and prosecute patent applications across diverse technologies, and coordinate with inventors and external counsel to secure and maintain patent rights. This role requires strong technical understanding, solid prosecution experience, and the ability to communicate complex concepts clearly to stakeholders.
Key Responsibilities

  • Prepare, draft, and file patent applications (provisional, nonprovisional, PCT, and foreign filings) across mechanical, electrical, software, or life sciences technologies as applicable.
  • Manage patent prosecution from initial filing through allowance and issuance, including responding to office actions and appeals.
  • Conduct prior art searches and freedomtooperate analyses to support patentability assessments and prosecution strategy.
  • Collaborate with inventors, R&D teams, and business stakeholders to identify inventions, capture technical disclosures, and develop effective claim strategies.
  • Coordinate and manage relationships with outside counsel and foreign associates for international prosecution and portfolio maintenance.
  • Review and analyze patent portfolios to recommend pruning, continuation, divisional, or maintenance strategies aligned with business objectives.
  • Prepare formal opinions, prosecution reports, and status updates for internal stakeholders and clients.
  • Ensure docketing accuracy, adhere to filing deadlines, and maintain organized prosecution files and records.
  • Support licensing, due diligence, and enforcement activities by providing prosecution histories and technical analyses as needed.

Qualifications

  • J.D. from an accredited law school and admission to practice in at least one U.S. jurisdiction; registration to practice before the USPTO (preferred or willing to obtain) highly desired.
  • Minimum 2-4 years of experience in patent prosecution at a law firm or in-house IP department; experience across U.S. and international filings preferred.
  • Technical background or degree (e.g., B.S., M.S., or Ph.D.) in engineering, computer science, life sciences, or a related field to understand and draft technical patent applications.
  • Proven experience drafting patent applications, preparing responses to office actions, and managing prosecution workflows.
  • Strong knowledge of patent law, USPTO procedures, PCT rules, and foreign patent prosecution practices.
  • Excellent written and verbal communication skills with the ability to explain technical and legal issues to nontechnical audiences.
  • Detail-oriented, organized, and able to manage multiple matters and deadlines in a fastpaced environment.
  • Demonstrated ability to work collaboratively with inventors, business stakeholders, and external counsel; experience with IP management systems and docketing software a plus.
