Official Internal Job Title: Head of Group Savings Compliance Status: Regular Job Description:

En tant que Chef de conformité en épargne collective : vous serez en appui au Chef de la conformité corporatif de Beneva et exercerez vos responsabilités pour le Cabinet Services investissements Beneva inc. (SIB) En tant que conseiller expert en conformité : vous serrez sous la responsabilité de la directrice conformité réglementaire et surveillance, et vous effectuerez la surveillance et la supervision des réseaux de distribution de Beneva et des personnes agissant pour son compte. Vous participerez à d’autres travaux de surveillance d’application de la réglementation, selon les besoins.

Vous vous réalisez dans les tâches et les fonctions suivantes :

  • Agir à titre de Chef de la conformité dans la discipline du courtage en épargne collective pour le Cabinet SIB en :
    • Portant dès que possible à la connaissance de la personne désignée responsable toute situation indiquant que SIB ou une personne agissant pour son compte peut avoir commis un manquement à la législation en valeurs mobilières ;
    • Surveillant et évaluant la conformité de la conduite de SIB et des personnes agissant pour son compte ;
    • Présentant au conseil d’administration de SIB un rapport annuel sur la conformité de la conduite de la société et des personnes agissant pour son compte avec la législation en valeurs mobilières ;
    • Agissant comme personne-ressource notamment auprès de ses pairs, de SIB, de la personne désignée responsable et du Chef de la conformité Beneva ;
    • Agissant comme personne-ressource auprès de l’Organisme canadien de réglementation des investissements (OCRI).
  • Collaborer activement à l’établissement et au maintien des politiques et procédures d’évaluation de la conformité des réseaux de distribution, incluant la mise en œuvre du programme de surveillance et sa mise à jour.
  • Contribuer à la planification des travaux de surveillance établi pour les réseaux de distribution de l’ensemble des provinces desservies par Beneva et veiller à leur réalisation.
  • Appliquer ou veiller à l’exécution du programme de surveillance des réseaux de distribution et participer à sa mise à jour, en effectuant notamment les tâches suivantes :
    • Recueillir les renseignements requis pour les travaux d’audit, les analyser conformément aux procédures et exigences réglementaires applicables et identifier les situations de non-conformité ;
    • Rédiger et acheminer les rapports et les avis de surveillance de façon à documenter les irrégularités identifiées et collaborer avec les gestionnaires et les intermédiaires dans le but de corriger celles‑ci ;
    • Déterminer les situations de non-conformité devant être escaladées et collaborer à la reddition de comptes ;
    • Effectuer les enquêtes sur les mauvaises pratiques de distribution et émettre des recommandations aux gestionnaires et aux intermédiaires, le cas échéant ;
    • Déclarer aux régulateurs toute situation de non-conformité concernant la pratique d’un intermédiaire, le cas échéant ;
    • Assurer un suivi des plans d’action demandés pour prévenir ou corriger tout risque ainsi que tout cas de non-conformité ;
    • Effectuer la supervision de 2e niveau relative aux activités de distribution en courtage en épargne collective ;
    • Accompagner et soutenir ses collègues de la direction en matière de conformité dans les réseaux de distribution.
  • Participer à divers mandats de conformité selon les besoins.
  • Représenter l’organisation en participant à divers comités internes et externes en lien avec la fonction de surveillance de la conformité.

Vos talents et qualifications :

  • Détenir un baccalauréat en administration ou en droit ou dans un domaine connexe avec un minimum de 10 ans d’expérience dans le domaine des services financiers, dont un minimum de 12 mois d’expérience pertinente dans le secteur des valeurs mobilières au cours des 36 derniers mois
  • Détenir le permis de représentant de courtier en épargne collective.
  • Avoir réussi le cours de Responsable de la conformité de la succursale (RCS) ou toute équivalence.
  • Avoir réussi l’examen du cours sur les fonds d’investissement canadiens, l’examen du cours sur le commerce des valeurs mobilières au Canada ou l’examen du cours sur les fonds d’investissement au Canada.
  • Avoir réussi l’examen à l’intention des dirigeants, associés et administrateurs (Examen AAD).
  • Tout autre critère d’acceptation reconnu par la règlementation applicable en valeurs mobilières
  • Posséder une connaissance approfondie de la réglementation, des règles et des pratiques dans le domaine de l’assurance de personnes pancanadien et des valeurs mobilières au Québec.
  • Maitrise de la langue française, tant à l’oral qu’à l’écrit, ainsi qu’une maitrise avancée de la langue anglaise, tant à l’oral qu’à l’écrit, en raison de la nature des tâches ou d’interactions avec des collègues, partenaires, clients ou fournisseurs anglophones, ou afin de répondre aux objectifs de croissance de l’entreprise.
  • À noter que la personne sélectionnée devra obtenir l’approbation de l’OCRI à sa nomination comme chef de la conformité dans la discipline du courtage en épargne collective.
