H 2A information

What jobs qualify for a H-2A visa?

H-2A visas are designated for temporary agricultural work, including planting, harvesting, pruning, packing, and other farm labor tasks. Eligible jobs typically involve manual labor in farming environments and require employers to demonstrate a need for temporary foreign workers. Workers often need to meet specific job requirements and obtain certifications related to agricultural skills.

What are H-2A workers?

H-2A workers are temporary agricultural workers who are admitted to the United States under the H-2A visa program. They perform seasonal farm work and must meet specific eligibility requirements, including labor certification and housing provisions, to work legally in the U.S. agricultural sector.

How do I get H-2A workers?

To hire H-2A workers, employers must file a temporary labor certification application with the U.S. Department of Labor, demonstrate a need for seasonal or temporary agricultural labor, and obtain an approved certification. They then submit a petition to U.S. Citizenship and Immigration Services (USCIS) to request the workers' visas, ensuring compliance with program requirements and providing housing and transportation for the workers. The process involves recruitment efforts to ensure no qualified U.S. workers are available for the job.

How much do H-2A workers get paid?

H-2A workers are typically paid at least the federal or state minimum wage, but their wages are often determined by the prevailing wage for agricultural work in the specific region. Employers are required to pay workers the highest of the prevailing wage, the federal or state minimum wage, or the agreed-upon contract rate, and wages are usually paid weekly or biweekly.
