Summary
This position is located in the Office of Appeals, Division of Enforcement Litigation. The Office of Appeals reviews all appeals to the General Counsel from Regional Directors' dismissals of unfair labor practice charges filed in the agency's regional offices. The General Counsel is vested with the sole power to review and sustain or deny these appeals and his/her decisions to deny appeals in such cases are not subject to review by the Board or appeal to any court of law or equity.

Duties

As a Attorney-Adviser (Labor) (Enforcement Appeals Attorney), GS-0905-11, your typical work assignments may include:

• Providing recommendations on analyzing appeal dismissals of unfair labor practice charges to recommend whether to sustain the dismissal, remand them for further investigation, or grant the appeal and set matters before a judge.
• Providing recommendations on in reporting orally to the General Counsel Agenda Committee a clear and succinct statement of the pertinent facts, legal issues and policy considerations to make recommendations as to the final deposition of the case.
• Providing recommendations on developing written records of the decisions in sustained appeal cases to ensure offices are informed of circumstances, inferences, legal conclusions, policy determinations, theories of the case, and remedial action to be sought.
• Providing recommendations on analyzing appeal decisions to determine if they are appropriate and how to proceed with the view of implementing and developing policies and procedures.
• Providing recommendations on ascertaining what substantive legal issues are raised by the facts, circumstances and inferences, based upon evidence of sufficient probative value, and identifies the major and minor procedural issues.

IDEAL CANDIDATE STATEMENT
The ideal candidate for the Attorney-Adviser (Labor) (Enforcement Appeals Attorney) will have experience preparing legal documents, including memoranda, and final documents on litigation theory, and presenting arguments or making presentations on factual and legal issues. Excellent communication and strong interpersonal skills to interact with attorneys, colleagues and senior level management in the Agency; and strong research and analytical skills are desired.
BASIC REQUIREMENT
Education: Must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LL.B. or J.D.). Law school transcripts must be submitted at the time of application.
Bar Membership and Certification: Must currently be a member in good standing of the bar of a state, territory, or commonwealth of the United States, District of Columbia, or Commonwealth of Puerto Rico. Your active Bar license must reference Bar number and indicate the status of good standing. Agency Internal Self-Certification Forms are not acceptable for verification.
In addition to the BASIC REQUIREMENT, applicants must also meet the following:
MINIMUM QUALIFICATIONS
Applicants must have one year of specialized experience, equivalent to the GS-09 grade level, which has provided them with the knowledge, skills, and abilities to successfully perform the duties of an Attorney-Adviser (Labor) (Enforcement Appeals Attorney) GS-11 grade level.
Specialized experience includes:

• Knowledge of labor, employment or administrative laws, similarly complex federal statutory scheme; and
• Experience conducting research to develop sound recommendations; and
• Experience communicating facts and issues relevant to case law.
