Job description

Overview
The Fintech Counsel will serve as the primary legal advisor supporting RealPage's payment processing, money transmission, and consumer lending operations. This role works closely with the SVP, Legal & Compliance to execute product development and compliance strategies across RealPage Payments (ClientDirect), ResidentDirect, ClickPay, and Livble. The Fintech Counsel is responsible for delivering practical, business-oriented legal guidance on financial product design, regulatory compliance, consumer protection, banking and service provider relationships, regulatory examination support, and data rights, ensuring each business unit operates within applicable legal and regulatory frameworks while advancing strategic growth objectives.
Responsibilities
Product Design & Development Counsel
  • Provide legal review and guidance on the design and launch of new and modified financial products and features across RealPage Payments (ClientDirect), ResidentDirect, ClickPay, and Livble.
  • Partner with product, engineering, and business teams from ideation through go-to-market to identify and mitigate legal and regulatory risk.
  • Advise on payment network rules, card brand requirements, ACH operating rules, and applicable state and federal payment regulations.
  • Support development of consumer-facing disclosures, agreements, terms of service, and product documentation for payment and lending products.
  • Evaluate product changes for licensing, regulatory filing, and change notification obligations.
  • Legal and regulatory due diligence to assess risk and advise corporate development and executive leadership in connection with M&A transactions and related strategic planning and execution.

Compliance Program Support
  • Advise on compliance program requirements applicable to money services businesses (MSBs), payment processors, and consumer lenders, including BSA/AML, OFAC, and state money transmission laws.
  • Support development, review, and maintenance of policies, procedures, and controls designed to satisfy federal and state regulatory requirements.
  • Monitor and analyze emerging laws, regulations, agency guidance, and enforcement actions affecting fintech, payments, and consumer lending; communicate implications to leadership and affected business units.
  • Provide legal guidance on Livble's consumer lending activities, including compliance with applicable federal consumer financial laws (e.g., TILA, ECOA, FCRA) and applicable state lending laws.
  • Assist in maintaining the compliance management system for in-scope business units.

Consumer Protection
  • Advise on consumer protection requirements applicable to payment processing and consumer lending, including UDAAP, Regulation E, Regulation Z, and applicable state consumer protection statutes.
  • Review marketing materials, disclosures, and consumer-facing communications for compliance with consumer protection standards.
  • Support complaint management processes, including analysis of consumer complaint data and identification of remediation measures.
  • Advise on fair lending and fair banking obligations applicable to Livble and other in-scope business units.
  • Assist in preparation of consumer compliance risk assessments and periodic self-assessments.

Banking & Service Provider Relationships
  • Negotiate and draft agreements with banking partners, payment networks, processors, program managers, and other financial services vendors.
  • Advise on bank-fintech partnership structures, including BaaS arrangements, agent relationships, and program management agreements.
  • Review and analyze sponsor bank agreements, operating procedures, and compliance requirements applicable to each in-scope business unit.
  • Support ongoing management of banking and service provider relationships, including compliance with contractual obligations and regulatory expectations applicable to third-party risk management.
  • Assist with due diligence for prospective banking, payments, and lending partners.

Regulatory Examination & Agency Relationship Support
  • Coordinate and support regulatory examinations, supervisory inquiries, and information requests from federal and state financial regulators (e.g., FTC, CFPB, NYDFS, state banking departments, FinCEN).
  • Assist in preparation of examination responses, management presentations, and supporting documentation.
  • Track examination findings and support implementation of required corrective actions and remediation plans.
  • Maintain awareness of regulatory priorities and examination trends applicable to payments and consumer lending businesses.
  • Support maintenance of state money transmission licenses and other regulatory authorizations applicable to in-scope business units.

Data Rights & Privacy
  • Advise on data rights, data sharing, and data monetization issues applicable to financial products and consumer financial data.
  • Provide guidance on the application of financial privacy laws (e.g., GLBA, FCRA) and state privacy statutes to payment processing, money transmission, and consumer lending activities.
  • Review data processing agreements, data use policies, and data sharing arrangements with banking partners and service providers.
  • Support compliance with open banking regulations and consumer data rights requirements as applicable to in-scope business units.
  • Partner with the privacy and information security teams to address data governance issues arising from financial product development and operations.

Qualifications
Required:
  • Juris Doctor (J.D.) from an ABA-accredited law school and active bar membership in good standing.
  • Minimum five (5) years of legal experience, with substantial focus on financial services, payments, money transmission, or consumer financial products, in a law firm or in-house legal department. Prior experience at relevant governmental or regulatory agencies a plus.
  • Demonstrated experience advising on payment processing, money services business operations, and/or consumer lending programs.
  • Working knowledge of federal consumer financial laws and regulations, including BSA/AML, Regulation E, Regulation Z, TILA, ECOA, FCRA, UDAAP, and GLBA.
  • Experience reviewing and negotiating financial services agreements, including bank partnership agreements, payment processing agreements, and vendor contracts.
  • Experience supporting regulatory examinations or supervisory inquiries by state or federal financial regulators.
  • Familiarity with state money transmission licensing requirements and NMLS.
  • Proficiency with MS Office and collaboration tools (Teams, SharePoint).

Preferred:
  • In-house legal experience at a fintech company, payment processor, bank, or financial services firm.
  • Experience with BaaS (Banking-as-a-Service) arrangements, program management structures, or sponsoring bank relationships.
  • Familiarity with CFPB supervision and examination processes.
  • Experience advising on consumer lending products, including point-of-sale financing, rent-related credit products, or installment lending.
  • Knowledge of open banking and consumer financial data access requirements.
  • Experience in a PropTech, SaaS, or technology company with embedded financial products.
