Job description

Independent Contractor Status

The Sales Representative is engaged as an independent contractor and not as an employee

of Burrage Roofing.

The contractor is responsible for all taxes, insurance, and obligations associated with

independent contractor status.

The Company will issue a Form 1099-NEC for compensation paid under this Agreement.

Scope of Services

The Sales Representative agrees to perform roofing sales services including generating

leads, meeting with customers, inspecting projects, presenting proposals, and securing

executed roofing contracts. All contracts must comply with company pricing, policies, and

approval procedures.

Daily Sales Rate

The Sales Representative shall be eligible to receive a Vehicle allowance of $300 per Month

if Quota is Reached:

  1. A valid and verified roofing contract.
  2. The Sales Representative obtains a minimum of five (5) executed contracts per workweek is eligible for a tank of gas
  3. No compensation shall be paid for any day in which a valid roofing contract is not

obtained.

The Company reserves the right to verify all contracts before compensation is issued.

Commission Structure

For every project sold, the company retains a $100 administrative fee in addition to the

10% overhead:

  • CRM usage
  • Office overhead
  • Insurance
  • Administrative processing
  • Job coordination
  • Accounting & invoicing support

Note: Company Cogs and Admin fees are taken out from the job total (Labor, Materials,

Admin):

  • 10% Overhead: 50/50 net profit split
  • Sales rep 50%
  • Company 50%
  • If company provides a lead 15% overhead 50/50 net profit split

A commission advance of $250.00 per contract may be issued upon:

  • Collection of Actual Cash Value (ACV); or
  • Receipt of at least fifty percent (50%) down payment from the customer (Jobs Must be approved to be eligible).

The remaining commission balance shall be paid after job completion, final invoicing,

full collection of funds, and file closure by the Company.

All commissions are subject to reconciliation, chargebacks, cancellations, or adjustments.

Contract Verification

A contract is considered valid and verified only when:

  • The customer has signed the agreement
  • Required documentation has been completed
  • The contract meets company approval standards
  • The project qualifies for installation by the Company (Approved)

Invalid, cancelled, or fraudulent contracts may result in non-payment or deduction from

future payments.

Non-Exclusivity

Nothing in this Agreement prohibits the Sales Representative from providing services to

other companies, provided such activities do not conflict with the interests of BRestored/ Burrage Roofing.

Company Vehicle Use

  • If provided a Company vehicle:
  • Vehicle use is strictly limited to work-related purposes.
  • Personal use is prohibited unless authorized in writing.
  • The Sales Representative must maintain safe operation, cleanliness, routine maintenance, and follow all traffic laws.

Misuse or negligence may result in revocation of vehicle privileges.

Termination

This Agreement may be terminated by either party at any time with or without cause upon

written notice.

Immediate termination may occur for:

  • Misrepresentation to customers
  • Fraudulent contracts
  • Violation of company policies
  • Unprofessional conduct

Hold Harmless and Indemnification

Contractor agrees to indemnify, defend, and hold harmless Burrage Roofing Construction &

Restoration, LLC, BRestored, and their owners, officers, employees, and affiliates from and

against any and all claims, demands, damages, losses, liabilities, costs, and expenses

(including reasonable attorney’s fees) arising out of or related to Contractor’s actions,

representations, omissions, or performance of services under this Agreement. The

contractor acknowledges that they are acting as an independent contractor and assumes full

responsibility for their conduct, business activities, and compliance with all applicable

federal, state, and local laws. Contractor further agrees that Burrage Roofing Construction &

Restoration, LLC shall not be held liable for any damages, claims, or disputes arising from

the independent Contractor’s work, customer interactions, or business activities conducted

on behalf of the Contractor.
