Job Overview

We are seeking a motivated, empathetic, and detail-oriented Workers' Compensation Attorney to join our claimant-side practice in Buffalo, NY. In this role, you will work fully on-site at our Buffalo office, managing a dedicated caseload and passionately representing injured workers through all stages of the New York State workers' compensation process. The ideal candidate possesses strong advocacy skills, an understanding of NYS Workers' Compensation Board (WCB) rules, and a commitment to helping claimants secure the medical care and lost wage benefits they deserve.


Key Responsibilities

  • Manage Caseload: Oversee claimant workers' compensation files from initial client intake through final resolution.
  • Client Advocacy: Communicate regularly with injured workers, provide compassionate legal counsel, guiding them through the medical treatment authorization process, and offering case updates.
  • WCB Appearances: Represent injured workers at virtual and in-person hearings, trials, and conciliation processes before the New York State Workers' Compensation Board.
  • Discovery & Depositions: Conduct and defend depositions of claimants, employers, and specialized medical experts.
  • Litigation Prep: Draft claim forms, formal depositions, WCB appeals, and comprehensive case evaluations.
  • Settlement Negotiation: Evaluate claim values (including Section 32 Waiver Agreements) and negotiate favorable settlements to maximize recovery for the injured worker.

Qualifications & Skills

  • Education: Juris Doctor (J.D.) degree from an accredited law school.
  • Licensure: Active license and in good standing with the New York State Bar.
  • Experience: Minimum of two years of practice specifically handling claimant New York State workers' compensation claims.
  • Knowledge: Familiarity with NYS Workers' Compensation Law
  • Communication: Exceptional written and verbal communication skills for drafting legal documents and conducting hearings; strong interpersonal skills for working with clients going through difficult times.
  • Organization: Ability to thrive in a fast-paced, fully on-site team environment while managing a high-volume caseload and statutory deadlines.
