Introduction

Delaware's Attorney\r\nGeneral, the State's chief law enforcement officer, has a broad responsibility\r\nto combat crime, uphold civil rights, safeguard families, fight fraud, and\r\nprotect consumers in the First State.\r\n\r\nIn meeting this mission,\r\nAttorney General Kathy Jennings is supported by teams of talented lawyers and\r\nstaff in the Criminal, Civil, Family, Fraud and Consumer Protection, and Civil\r\nRights and Public Trust Divisions. Each of the more than 500 staff who work in\r\nthe Office of the Attorney General are dedicated to serving all Delawareans\r\nwith integrity and passion.\r\n\r\nThe White Collar Crime Unit (WCCU) is part of the\r\nFraud and Consumer Protection Division and\r\nis based in New Castle County.\r\nDAGs in WCCU prosecute crimes statewide that involve financial\r\nmisconduct and such other criminal matters assigned by the Division Director.\r\nThe WCCU also pursues civil actions under the Delaware False Claims and\r\nReporting Act for fraud committed against the government.\r\n\r\n\r\n

The\r\nDelaware Department of Justice is looking for a highly motivated and committed deputy attorney\r\ngeneral to join the White Collar Crime Unit to fill its "Wage Theft" DAG\r\nvacancy. While the successful candidate\r\nwill work as a member of the WCCU team on the full range of cases handled by\r\nthe unit, this position will have primary responsibility for leading the Division's efforts related to labor-related crimes and\r\nmisconduct. \r\n\r\n**This\r\nposition may be eligible for telework for up to three day per week**\r\n

Essential Functions

This deputy\r\nattorney general, under the guidance of Unit leadership, will decide what cases\r\nshould be prosecuted, which should be resolved by trial, and will try the cases\r\nthat are not otherwise resolved. While\r\nthe WCCU is based in New Castle County, this position will handle criminal\r\nmatters statewide and travel throughout the state is contemplated. This position will be responsible for leading\r\nthe Department's initiative focused on labor-related crimes and\r\nmisconduct. In that role, the DAG will\r\ndirect the investigation and, when appropriate, prosecution of cases involving\r\nworker exploitation and wage theft. The\r\nDAG will play an instrumental role in the development of prosecutions brought\r\nunder the recently enacted statute establishing wage theft as an offense under\r\nthe Delaware criminal code. In\r\ndeveloping this novel area of prosecution, the DAG will be expected to\r\ncoordinate with peers in other jurisdictions, participate in training to\r\ndevelop proficiency and, in turn, conduct training for investigators and\r\nsupport personnel engaged in this effort.\r\nAdditional\r\nduties for the DAG would include representing the Unit at meetings involving\r\nbusiness crime issues, including with federal counterparts, meeting with\r\nreferral agencies to address issues in the investigation and prosecution of\r\ncases within the Unit's jurisdiction, performing intakes and reviewing cases\r\nfor prosecution. This DAG will work as\r\npart of a team with the other members of the WCCU on the full range of WCCU\r\ncases.\r\nBecause the\r\nWCCU works closely with, and relies upon, our investigative partners throughout\r\nthe State, the successful candidate must have or be able to develop a good\r\nworking relationship with other deputy attorneys general, investigative\r\npartners, support staff and court personnel.\r\n

Job Requirements

This is a\r\nchallenging position that provides an opportunity to investigate and litigate a\r\nwide range of matters including many large and complex frauds. This deputy\r\nattorney general should be able to work independently and meet deadlines.\r\nCandidates should have an understanding of all facets of the investigation and\r\nlitigation of complex criminal matters.\r\nThe strongest candidates will have substantial felony trial experience,\r\nsubstantial experience handling document-intensive cases involving financial\r\nmisconduct, and have demonstrated the ability to evaluate criminal cases, to\r\ndetermine resolutions, and to anticipate legal issues. Familiarity with\r\nfinance, tax, accounting or labor law is helpful, but not a prerequisite. Admission to the Delaware Bar, or a willingness\r\nto sit for the next Delaware Bar Exam, is required. We seek an\r\nindividual with a strong commitment to working in the public interest.\r\n
