Attorney – Real Estate Litigation
Volk Law Offices, P.A. – Melbourne, Florida

Volk Law Offices, P.A., an established business and real estate firm on Florida’s Space Coast, seeks an experienced Real Estate Attorney to handle a mix of civil matters, land use, and real estate development work for businesses, investors, and property owners in Brevard County and beyond.

Position overview

You will advise and represent clients in matters involving:

  • Commercial and residential real estate transactions and disputes (contracts, title, leasing, financing, and related issues).
  • Land use, zoning, entitlements, and permitting for development and redevelopment projects.
  • Development-related issues including site plans, plat approvals, development agreements, easements, covenants, and restrictions.
  • Civil litigation related to real property, business, and construction disputes, as needed.

This is a full-time, on-site position in Melbourne, Florida with views of the intracoastal waterway!

Key responsibilities

  • Counsel clients on acquisition, sale, financing, leasing, and development of commercial and residential real estate.
  • Draft, review, and negotiate purchase and sale agreements, leases, options, easements, restrictive covenants, development agreements, and related real estate and business contracts.
  • Handle land use and zoning matters, including comprehensive plan and zoning interpretations, variances, conditional uses, and related administrative or quasi-judicial hearings.
  • Work with local governments, planning staff, engineers, and consultants on permitting and approvals for real estate development projects.
  • Assist with real property disputes, including boundary, easement, title, landlord/tenant, construction, and related civil litigation matters.
  • Conduct legal research, prepare opinions, and keep clients informed with clear, practical advice.
  • Collaborate with other attorneys and staff in a team-oriented, client-focused environment.

Qualifications

  • Juris Doctor from an accredited law school.
  • Active member in good standing of The Florida Bar.
  • 5+ years of substantive experience in real estate law, with meaningful exposure to land use, zoning, or real estate development matters (law firm or in-house).
  • Solid knowledge of Florida real estate law and familiarity with local government land use processes.
  • Experience drafting and negotiating real estate contracts and development-related documents.
  • Litigation experience involving real property or business disputes is strongly preferred.
  • Strong writing, analytical, and oral advocacy skills, with the ability to communicate clearly with business clients, developers, and governmental entities.
  • Demonstrated professionalism, responsiveness, and a community-focused mindset.
