Position Overview

Smoker & Company LLC is seeking an experienced Tax Attorney with approximately 3-5+ years of relevant experience to advise individuals, closely held businesses, and business owners on a variety of federal, state, and local income tax matters, including tax planning, compliance, controversy matters, and related tax issues. This role focuses on planning, compliance support, legal research, notices, audits, appeals, collections, and other tax controversy matters, with particular emphasis on pass-through entities, including S-Corporations and LLCs.

The Tax Attorney will work closely with internal accounting, tax preparation, advisory, and leadership teams to provide practical legal guidance, identify tax risks and opportunities, and help clients navigate complex tax issues with confidence. The ideal candidate is a detail-oriented legal professional with strong tax technical knowledge, sound judgment, excellent communication skills, and a client-service mindset.

Qualifications

Required

  • Juris Doctor degree from an accredited law school.
  • Active license to practice law in Pennsylvania.
  • Strong working knowledge of federal, state, and local income tax laws, regulations, procedures, and filing requirements.
  • Approximately 3-5+ years of experience with individual and business tax planning, compliance review, legal research, or tax controversy matters.
  • Ability to manage multiple priorities, meet deadlines, and communicate clearly with clients and internal teams.
  • Strong written and verbal communication skills.

Preferred

  • Bachelor's degree in accounting, finance, business, or a related field.
  • LL.M. in Taxation, CPA license, or other relevant tax credentials.
  • Experience representing clients before the IRS, Pennsylvania Department of Revenue, or local taxing authorities in income tax audits, appeals, collections, or notice resolution matters.
  • Admission to the U.S. Tax Court, or eligibility and willingness to seek admission.
  • Experience advising S-Corporations, LLCs, partnerships, and other pass-through entities, including related state and local tax matters.
  • Experience working in a CPA firm, law firm, or professional services environment.
  • Familiarity with Microsoft Office and tax preparation, research, or workflow management software.

  • Advise individuals, business owners, closely held businesses, and pass-through entities, including S-Corporations and LLCs, on tax planning strategies designed to manage tax liabilities and support financial goals.
  • Review individual, business, fiduciary, and related income tax returns, supporting schedules, notices, and documentation for accuracy, completeness, and compliance.
  • Analyze the federal, state, and local income tax implications of business transactions, entity selection, ownership changes, compensation arrangements, distributions, pass-through taxation, and other client-specific matters.
  • Stay current on income tax law changes and communicate relevant updates to clients and internal team members.

Income Tax Controversy and Client Representation

  • Represent and advise clients on federal, Pennsylvania, and local income tax notices, audits, appeals, collections, penalty matters, and other tax controversy issues.
  • Communicate with the IRS and state or local taxing authorities on behalf of clients to help resolve tax inquiries, disputes, and compliance issues.
  • Prepare responses, correspondence, legal analysis, memoranda, appeals materials, and supporting documentation related to client income tax matters.
  • Evaluate risk, explain available options, and recommend practical courses of action for clients facing income tax issues.

Client Service and Collaboration

  • Communicate with clients to gather information, explain tax matters, and provide responsive, professional service.
  • Collaborate with accountants, tax preparers, advisors, and firm leadership to address client needs and coordinate service delivery.
  • Build and maintain strong client relationships through accurate, courteous, and timely communication.
  • Coordinate with tax preparers and advisors to ensure legal guidance is integrated with income tax compliance and planning work.
  • Maintain confidentiality of client financial information and uphold firm standards for professionalism and integrity.
