The Benton County Attorney's Office is seeking a dedicated Assistant County Attorney I or Assistant County Attorney II to join our team of legal professionals committed to upholding justice and serving the people of Benton County. This position offers the opportunity to work on diverse, complex legal matters in both criminal and civil law. Its primary responsibility is criminal prosecution, with a strong focus on the prosecution of felony-level crimes. Schedule: Full-Time | Rotating On-Call Responsibilities | Other hours as needed, with the ability to earn comp time.
Compensation:

Assist the County Attorney in the performance of professional legal duties, including providing legal counsel to Benton County and prosecuting criminal cases in Benton County.
Essential Duties and Responsibilities

Duties and ResponsibilitiesEssential Functions - CRIMINAL ATTORNEY
A. Represent Benton County and the State of Minnesota by prosecuting petty misdemeanors, misdemeanors, gross misdemeanors, and felonies.
B. Attend all criminal hearings, including first appearances, bail hearings, pretrials, contested evidentiary hearings, settlement conferences, trials, sentencings, restitution hearings, probation violations, post-conviction relief hearings, grand jury proceedings, and oral arguments at the appellate courts.
C. Draft criminal complaints by reviewing and analyzing police reports, video, and other evidence.
D. Perform file review, including review of criminal histories, sentencing guidelines, legal research, rules of criminal procedure, case law, and Minnesota statutes.
E. Communicate and coordinate with witnesses, victims, pro se defendants, and other attorneys.
F. Complete legal research and prepare motions and briefs to submit to the district court.
G. Advise the Victim Services Coordinator position and manage relationships with victims of crimes and analyze restitution claims.
H. Negotiate with defense counsel or pro se defendants.
I. Advise and train law enforcement on legal issues and assist with drafting and approving search warrants.
J. Prepare for and attend hearings related to extradition/fugitive from justice, expungement, and the restoration of firearms rights.
K. Prepare documents involving appeals to the Minnesota appellate courts.
Additional Functions
A. Attend training as needed.
B. Rotate on-call responsibilities.
C. Perform other duties as assigned or apparent.
Minimum Qualifications - Training and Experience Required

A. Juris Doctor (JD) from an accredited law school; and
B. Must be licensed to practice law in the State of Minnesota; and
C. One (1) year of relevant work experience.
D. Must possess a valid driver's license and be able to drive in the State of Minnesota.

G. Ability to train on various programs/roles within the department; and
H. Ability to mentor and provide guidance to Assistant County Attorneys I; and
I. Regular attendance according to the department's work schedule; and
J. Maintain good standing performance; and
K. Maintain safety, data privacy, and data security training; OR
L. Equivalent combination of education/training/experience.
M. Must possess a valid driver's license and be able to drive in the State of Minnesota.

Physical Demands & Working Conditions
A. Work is performed primarily in an office, courtroom, or community setting.
B. Work is performed in the office, in a courtroom, and in the community. Telework may be permitted, at the discretion of the County Attorney, when the employee is not required to be in the office, in court, or in the community.
C. Headaches, eyestrain, and other related occupational hazards reflect the most common potential for injury.
D. Light physical effort in sedentary to light work, but which may involve some lifting, carrying, pushing, and/or pulling of objects and materials up to 20 pounds.
E. Some exposure to verbal abuse from hostile, angry, or frustrated individuals.
F. This position frequently requires meticulous attention to detail, accuracy, and the ability to effectively manage competing priorities and deadlines in the performance of legal work.
