Incyte's Intellectual Property team is seeking an experienced Patent Agent with pharmaceutical or biopharmaceutical industry expertise. This position is responsible for providing services incident to US patent prosecution, including the review and drafting of patent applications and other prosecution-related documents for Incyte's pharmaceutical or biopharmaceutical products and technologies, and interacting with the US Patent and Trademark Office (USPTO).
Primary Job Functions:
  • Manage the preparation, filing, prosecution and maintenance of US patent applications and patents to obtain broadest possible protection for all aspects of the company's inventions relating to pharmaceuticals or biopharmaceutical therapeutics.
  • Provide strategic guidance and services regarding filing patent applications and other documents with the USPTO, and relevant intellectual property issues including inventorship and conception/reduction to practice of inventions.
  • Assist in ensuring all commercially important assets are protected by valid US patents.
  • Support proceedings before the USPTO involving company or third-party intellectual property, such as inter partes reviews, post grant reviews, re-examinations, re-issues, petitions and appeals.
  • Design and execute comprehensive small and large molecule prior art searches using specialized databases.
  • Review and/or evaluate literature, patent and file wrapper searches on subject matter relevant to the company's US patent prosecution.
  • Review and provide strategic guidance regarding the filing of US patent applications to protect Incyte's interest in scientific/technical/clinical publications originating either internally or with third party collaborators.
  • Produce patent status and docket reports.
  • Ability to work with outside US patent counsel to direct and manage activities before the USPTO.
  • Develop a thorough understanding of the company's business, including its people, products, markets, facilities, customers and competitors and utilize that knowledge in providing guidance to internal clients.
  • Establish a rapport and a working relationship with company business units at all levels to encourage and continue their proactive use of in-house legal services.

Minimum Requirements
  • Registered Patent Agent in good standing to practice before the United States Patent & Trademark Office (USPTO).
  • Ph.D. or Master's degree in Organic Chemistry, Biochemistry, Immunology, Molecular Biology, Pharmacology, or a related pharmaceutical or biopharmaceutical discipline.
  • At least 3 years of in-house and/or private practice experience as a patent agent in the pharmaceutical or biopharmaceutical field.
  • Demonstrated experience and proven track record in preparation, prosecution and management of US patent portfolios relating to the pharmaceutical and/or biopharmaceutical industries.
  • Strong understanding of and experience with the rules and regulations of the USPTO.
  • Demonstration of solid organizational skills, the ability to think strategically and sound judgment in the analysis of complex business issues.
  • Excellent written and verbal communications skills, including the ability to communicate concisely to clients, to integrate patent and business knowledge, and to provide strategic guidance regarding Incyte's US patent prosecution.
  • Ability to manage multiple tasks simultaneously and to flourish in a fast-paced environment, both individually and as part of a team.
