Job description

The Staff Pad is seeking an experienced and highly motivated Probate Attorney to join a growing legal team in Albuquerque, New Mexico, in an Of Counsel capacity. This part-time position is expected to require approximately 10–15 hours per week and is ideal for a seasoned attorney who is passionate about probate and estate administration, values client service, and seeks flexibility while maintaining a sophisticated legal practice.

The successful candidate will provide legal counsel and representation in probate, trust administration, guardianship, conservatorship, and related estate matters. This role offers significant flexibility while allowing the attorney to remain actively engaged in meaningful legal work and client advocacy.

Key Responsibilities
  • Manage probate and estate administration matters from inception through resolution.
  • Advise executors, personal representatives, trustees, and beneficiaries regarding estate and trust administration.
  • Prepare and review probate pleadings, petitions, motions, inventories, accountings, and related legal documents.
  • Represent clients in probate court hearings, contested probate proceedings, guardianships, and conservatorships.
  • Provide legal guidance on trust administration and fiduciary obligations.
  • Conduct legal research and draft memoranda on probate and estate-related issues.
  • Collaborate with attorneys and staff to ensure efficient case management and client communication.
  • Develop and maintain strong relationships with clients, referral sources, and community stakeholders.
  • Ensure compliance with all applicable New Mexico laws, court rules, and ethical standards.
Qualifications
  • Juris Doctor (J.D.) from an accredited law school.
  • Active license and good standing with the New Mexico State Bar, or ability to obtain admission promptly.
  • Minimum of 5+ years of probate, estate administration, trust administration, or related legal experience.
  • Strong knowledge of New Mexico probate laws and court procedures.
  • Experience handling contested and uncontested probate matters.
  • Excellent legal writing, analytical, negotiation, and advocacy skills.
  • Ability to manage cases independently with minimal supervision.
  • Exceptional interpersonal and client relationship management skills.
  • Strong organizational skills and attention to detail.
Preferred Qualifications
  • Established probate or estate planning practice.
  • Experience with trust litigation, guardianships, and conservatorships.
  • Existing referral network within the Albuquerque legal and professional community.
  • Portable book of business is a plus but not required.
