Job description

Deputy Division Director - Highways & Utilities Division

The Utah Attorney General's Office is seeking an experienced attorney to serve as Deputy Division Director for the Highways & Utilities Division, overseeing legal representation for the Utah Department of Transportation, the Division of Public Utilities, the Office of Consumer Services, and the Department of Public Safety.

This leadership position focuses on managing and litigating complex matters in district courts throughout the State. At least 3-5 years of complex litigation experience is required. Experience with complex litigation is highly valued. 

Must have experience showing ability to work collaboratively as well as independently. Current membership in the Utah State Bar is required.

Responsibilities:

  • Provides consultation, makes recommendations, gives appropriate advice, and/or facilitates decisions.
  • Trains attorneys in all aspects of litigation practice.
  • Provide training to client agencies and employees.
  • Acts as a sounding board and resource for attorneys as they evaluate, prepare, and try cases.
  • Prepares cases by conducting legal research, preparing witnesses, and gathering evidence.
  • Develop and enforce division policies and procedures.
  • Drafts, reviews, and recommends contract language.
  • Drafts proposed legislation and makes recommendations regarding proposed legislation to client agencies and employees.
  • Determine needs in discovery, and/or completes discovery; participates in decision making and strategy sessions in preparing cases for court and determining evidence to be used.
  • Writes or drafts correspondence, reports, documents and/or other written materials.
  • Receives, researches and responds to incoming questions or complaints; provides information, explains policy and procedures, and/or facilitates a resolution.
  • Represents the state or the employing agency in lawsuits, grievances, and complaints.
  • Drafts litigation working documents; prepares documents consisting of concise decisions based upon facts of case interpretations of law and compliance with state and federal standards.
  • Conduct conferences with defendants and/or attorneys and negotiate settlements.
  • Represents clients at formal or informal hearings.
  • May be required to travel to various locations and stay overnight.
