For over 25 years, National Experienced Workforce Solutions (NEW Solutions) has specialized in connecting experienced workers (ages 55+) with full-time and part-time job opportunities that support the critical missions of Federal Agencies across the United States.

NEW Solutions connects experienced workers (ages 55+) with the USDA Agricultural Research Service (ARS). These experienced professionals provide administrative, scientific, and technical support to the Agricultural Research Service through the Experienced Worker Program (EWP).

Positions listed here do not guarantee employment for any definite period. Enrollment in the Experienced Worker Programs administered by NEW Solutions is temporary. The enrollment relationship between NEW Solutions and the Enrollee is an ?at-will? relationship. This means that an Enrollee is free to terminate enrollment at any time during the enrollment period, and NEW Solutions and the Agency have the right to terminate the relationship with the Enrollee.

PLEASE NOTE: An ?Enrollee? is not a federal employee, nor an employee of NEW Solutions. An ?Enrollee? is a participant in a grant program established through a Cooperative Agreement funded by the agency and administered by NEW Solutions. The enrollee shall not sign federal documents, authorize the use of federal funds, nor initiate or conduct federally funded research projects. The enrollee shall not author articles for publication as a federal employee, nor coordinate scientific research between the Government and private industry. The enrollee shall not present themselves as a Government employee or Government representative at meetings both foreign and domestic or when coordinating federal agencies? areas of research. Qualifications:

Minimum of 20 year(s) of experience in preparation/drafting and prosecution of provisional and non-provisional patent applications. OR PhD Degree in Microbiology

  • Registered to practice before the United States Patent and Trademark Office (USPTO)
  • Experience required with Windows, MS Word, MS Excel
  • Microsoft Teams, and SharePoint
Duties:

Provide expert advice and recommendations for the preparation and prosecution of all assigned patent and PVP applications. All ARS patents shall be filed through the USDA, Office of General Counsel (OGC), in accordance with Departmental Regulation 5700-001 and ARS Policy and Procedures (P&P) 141.2. The enrollee shall not sign federal documents, authorize the use of federal funds, nor initiate or conduct federally funded research projects. The enrollee shall not author articles for publication as a federal employee, nor coordinate scientific research between the Government and private industry. The enrollee shall not present themselves as a Government employee or Government representative at meetings both foreign and domestic or when coordinating federal agencies? areas of research. The enrollee shall not make decisions on federally based research on behalf of Government policy makers, and the enrollee shall not supervise any Government employees.

  • Provides expert advice and recommendations on the preparation and prosecution of provisional and non-provisional patent applications. Fully develops the record to include information disclosure statements, amendments, responses to office actions, petitions, appeals, and other forms of response required to establish patentability. Submits all responses within established time periods. As appropriate, participates in inventorship determinations and interviews with Examiners. Bases patent-related judgements on established case law. Provides expert advice and recommendations on the evaluation of plant releases and the preparation of plant patent and PVP applications for filing and on the prosecution of said applications to establish protectability.   50%
  • Provides expert advice and recommendations on domestic and foreign patent rights, policies, and procedures. Identifies and evaluates patentable subject matter arising from USDA research and collaborates with Patent Committee(s) to determine if patent applications should be filed on specific inventions.   20%
  • Provides expert advice and recommendations on the coordination and monitoring of the filing and prosecution of patent applications handled by co-owners or outside counsel. Participates in Ad Hoc Patent Committee and provides expert advice and recommendations on proposed actions of outside counsel regarding foreign patent prosecution.   10%
  • In matters of controversy such as those relating to title of invention, inventorship, or joint ownership, participates in the in-depth investigations to determine salient facts; uses findings to resolve issue or furnishes facts to Agency staff for resolution of the matter.   10%
  • Completes special tasks as assigned and participates on task forces and/or teams as directed.   10%
