About the Practice Group
Latham's Supreme Court & Appellate team consistently secures precedent-setting, high-stakes victories for clients before the US Supreme Court and federal and state courts of appeal.
Our appellate team provides clients with insightful, powerful representation. Team members have served as high-ranking officials in the US Department of Justice, clerked for Supreme Court Justices and federal judges, and argued hundreds of cases before appellate courts. Notably, four of our appellate lawyers have served in positions in the Solicitor General's office. Latham also boasts more than a dozen former Supreme Court clerks and 60+ former US Court of Appeals clerks from all 13 circuit courts.
Our track record before the Supreme Court includes numerous precedent-setting victories, and we have an exceptional success rate in seeking and opposing certiorari on behalf of clients. We repeatedly prevail in litigation against the US government representing Fortune 100 corporations, state governments, leading educational institutions, and individuals - especially in cases raising novel or challenging questions of administrative law - and in addition to preparing petitions for certiorari, we regularly craft merits and amicus briefs. Five different lawyers have argued more than a dozen cases before the US Supreme Court in the last four terms, contributing to our impressive record of 100+ arguments presented by Latham lawyers before the Court since 2001. We remain attuned to the Court by working on highly consequential Supreme Court cases all year, every year across a wide range of industries and issues.
The appellate team frequently handles complex litigation and dispositive motions in the lower courts and before regulatory agencies. Latham's hallmark collaborative approach ensures that before a matter even reaches the appellate phase, the firm's appellate lawyers are working hand-in-hand with trial teams to persuasively frame and preserve issues for appeal.
When a case reaches the appellate stage, regardless of jurisdiction, we enter the courtroom with vast collective experience arguing and winning cases in that very venue. About the Role
The Supreme Court & Appellate Practice is seeking highly qualified associates to join our group. This is an exciting opportunity to work with our nationally recognized, Chambers Band 1 appellate practice on high-stakes appeals, key trial-court motions, and legal strategy. At minimum, candidates must have completed an appellate clerkship and possess strong analytical, research, and writing skills. We also welcome candidates with appellate litigation experience at a firm or in government service.
