Position Summary

Asset Based Lending LLC (“ABL”) is a national private lender originating business-purpose loans exclusively to entity borrowers, secured by non-owner-occupied real estate. ABL is establishing a dedicated, standalone compliance function and seeks a Sr. Compliance Officer to build, implement, and own that function end to end.

This is a newly created, single-person role for a self-starting, investigative professional who can hit the ground running—designing the compliance program, standing up its infrastructure, and operating it day to day. The Sr. Compliance Officer will work under the direction of the General Counsel and the Chief Executive Risk Officer to ensure that ABL and its affiliated entities remain in compliance with applicable federal and state laws, regulations, licensing obligations, contractual requirements, and internal policies. The successful candidate is equal parts builder and operator: capable of writing the policy, implementing the control, running the monitoring, and proactively investigating to surface non-compliance before it becomes an exam finding or a loss event.

Key Responsibilities

Program Build-Out & Risk Assessment

  • Design, document, and operate ABL’s enterprise compliance program from the ground up with written CMS, policies and procedures, compliance calendar, and a risk-based monitoring and testing framework.
  • Maintain a compliance risk assessment program across lending, capital markets, servicing, foreclosure, and collection activities; establish recordkeeping, escalation, and periodic reporting to the General Counsel and Chief Executive Risk Officer.

Licensing & NMLS Administration

  • Own all entity licensing across ABL’s footprint: maintain, renew, and amend lender, broker, servicer, and collection licenses; track license conditions, surety bonds, and financial filings.
  • Administer NMLS records, advance change notices, renewals, and Mortgage Call Reports; determine and document new licensing obligations before entering new states, products, or activities.

Regulatory Compliance

  • Maintain an inventory of applicable federal and state laws and monitor, changes, regulatory developments, guidance, and enforcement trends.
  • Administer applicable federal requirements (ECOA/Reg B, HMDA, etc.) and determine and document the applicability of purpose- or collateral-driven regimes (TILA/Reg Z, RESPA) rather than assuming blanket application or exemption.
  • Administer applicable state requirements such as lending/broker licensing; usury limits, rate-ceiling elections, and choice-of-law; business-purpose disclosure and document-delivery rules; commercial debt-collection statutes; and UDAP/UDAAP standards.

Reporting, Examinations & AML Support

  • Prepare and submit required regulatory reports and filings (Mortgage Call Reports, HMDA LAR where reportable, state periodic/annual reports, bond and financial filings); serve as primary contact and project manager for examinations, audits, and inquiries, tracking corrective actions to completion.
  • Support ABL’s AML/BSA program, OFAC/sanctions screening, and suspicious-activity monitoring.

Servicing, Entity & Vendor Compliance

  • Build and oversee the servicing compliance framework: determine and document applicable state servicer/collection-agency licensing and bonding, the commercial-collection legal framework governing ABL’s business-purpose debt, and servicing controls (payoff/reinstatement, escrow, default-servicing and foreclosure referral) consistent with state law and investor requirements.
  • Keep ABL and all affiliated entities active and in good standing (annual reports, franchise taxes, registered agents, foreign qualifications) in coordination with the Secretary’s function.
  • Maintain a vendor/third-party oversight program covering contractual obligations, vendor insurance/licensing, data-security and confidentiality terms, renewal/auto-renewal dates, and ABL’s own covenant.

Capital Markets Compliance

  • Maintain compliance with agreements between ABL and its capital partners, including MLPAs and servicing agreements.

Investigation, Training & Other

  • Proactively root out non-compliance through monitoring, file testing, trend and complaint analysis, and internal audits; investigate escalations, drive remediation, and escalate material issues to the General Counsel and Chief Executive Risk Officer.
  • Develop and deliver compliance training; serve as the internal compliance resource; and perform other compliance duties necessary for a national private business-purpose lender and servicer.
Qualifications

Required

  • Bachelor’s degree; 5+ years of progressive compliance experience in mortgage, consumer or commercial lending, loan servicing, or financial-services regulatory compliance.
  • Working command of the federal and state regulatory framework applicable to non-bank lending and servicing, including state licensing and NMLS administration, fair lending, privacy, AML/SAR, and the analysis of which consumer-protection regimes do and do not reach business-purpose, entity-borrower transactions.
  • Hands-on NMLS administration experience (company, branch, and individual records; renewals; Mortgage Call Reports).
  • Strong investigative instinct, exceptional attention to detail, and the ability to self-direct, prioritize, and execute independently with minimal infrastructure.
  • Excellent written and verbal communication; ability to interface credibly with regulators and examiners.

Preferred

  • Demonstrated experience building or substantially rebuilding a compliance function or program (not solely operating an existing one).
  • Experience with business-purpose / private / lending (bridge, fix-and-flip, new construction, DSCR/rental, multifamily) and with non-owner-occupied residential collateral.
  • Experience standing up or supporting a loan-servicing or debt-collection function, including state collection-agency/servicer licensing.
  • Multi-state licensing experience across a large footprint (40+ states).
  • Industry certification (e.g., CRCM, CAMS, or comparable).
  • Familiarity with secondary-market / whole-loan sale obligations and investor compliance requirements.
