Main Purpose of Job

This is a supervisory level of work as a law enforcement agent enforcing and investigating violations of the alcoholic beverage, tobacco products and Cannabis / THC products laws for the State of Maryland. Provide oversight, management, and supervision of the Division's inspection programs designed to gain voluntary compliance of the regulated industries (i.e. Alcohol, Tobacco, Cannabis / THC & ESD). Function is to assure proper state licensure, protect revenue sources and the public's health and well-being, and to maintain a fair and balanced environment for Maryland business to compete in. The work of this class involves supervisory, operational, and administrative responsibilities for Enforcement Agents. This position requires separate and distinct supervisory and administrative responsibilities with equivalent level of authority and necessitates the supervisor designation as administrative or operational.\r\n

POSITION DUTIES

Operational \r\nPlan and supervise criminal investigations involving alleged\r\nviolations of the laws relating to: \r\n(1) The illegal manufacturing, sales, importation, distribution,\r\nand use of alcoholic beverages to protect a source of revenue and protect\r\ncitizens from the indiscriminate manufacturing and distribution of alcoholic\r\nbeverages.\r\n(2) To enforce all tobacco, cigarette and ESD laws pertaining to\r\nthe illegal sales, transportation, storage, possession of contraband tobacco\r\nand cigarettes, counterfeit cigarettes, or counterfeit stamps in order to\r\nprotect revenues and legitimate businesses.\r\n(3) To enforce laws pertaining to cannabis / THC products which\r\nare grown, produced and sold in the State of Maryland. Also, to protect the revenues for legitimate\r\nbusinesses engaging in cannabis / THC products within the State of Maryland.\r\n(4) To enforce laws and regulations of the Health General Article\r\nand Alcoholic Beverages and Cannabis Article as they relate to Kratom,\r\nPhenibut, Tianaptine and other unauthorized consumable products.\r\nThese essential functions are accomplished by performing the\r\nfollowing duties:\r\n\r\n Participate as the on-site\r\n supervisor of enforcement personnel assigned to conduct surveillance and\r\n investigations both within and outside the State of Maryland. \r\n Initiates investigations\r\n involving alcohol, tobacco, cannabis / THC and ESD violations perpetrated\r\n against the state. \r\n Plan and supervise all types of\r\n investigations from conception to completion. \r\n Review intelligence reports\r\n completed by team members and evaluated and make recommendations as to the\r\n status and course of ongoing investigations. \r\n Review all reports completed by\r\n investigative personnel for content and accuracy relative to ongoing and\r\n completed investigations. \r\n Ensures that all reports are\r\n completed on time and are forwarded to the appropriate staff personnel in\r\n accordance with Field Enforcement Rules and Regulations. \r\n Evaluate all completed case\r\n reports for proper presentation to administrative bodies, local, state,\r\n and federal prosecutors to be used in Court and Administrative\r\n proceedings. \r\n Oversee the preparation of and\r\n execution of search and seizure warrants ensuring proper documentation and\r\n notification of property seized to both owners and the Court. \r\n Participate in and maintain\r\n supervisory control of traffic stops of violators and their subsequent\r\n arrest to include searches of persons and vehicles incident to the arrest.\r\n \r\n Testify in Circuit and District\r\n Court criminal proceedings and in Federal Court proceedings as well as\r\n before local Liquor Control Boards and Administrative Hearings within the\r\n Alcohol, Tobacco & Cannabis Commission. \r\n Make recommendations to the Agent\r\n in Charge of the FED, Field Operations Bureau, Division Director, or\r\n Deputy Director regarding trends for future enforcement efforts based on\r\n review and evaluation of data gathered by field operatives and information\r\n derived from ongoing investigations. \r\n Other duties as assigned, to\r\n include those relevant to any current or future Memorandum of\r\n Understanding (MOU) such as the ones between the Alcohol, Tobacco &\r\n Cannabis Commission (ATCC), Maryland Cannabis Commission (MCA),\r\n Comptroller of Maryland (FEB), and any other entity.\r\n\r\nAdministrative Functions\r\n\r\n Prepare monthly unit schedule for\r\n routine and specialized investigations to ensure adequate supervision,\r\n manpower and availability of other necessary resources. \r\n Continually update daily work\r\n schedule to accommodate changes necessitated by manpower requirements for\r\n investigations, Circuit Court and District Court appearances and response\r\n to citizen complaints and those generated by allied agencies. \r\n Act as liaison to the District\r\n Court and State's Attorneys Offices to coordinate submission of reports\r\n for case prosecutions and appearances by Agents for preliminary inquiries\r\n and Court proceedings. \r\n Ensure proper collection and\r\n submission of Uniform Crime Reports to the Agency Coordinator. \r\n Review for accuracy and\r\n coordinate dissemination of State and FBI Fingerprint records to the\r\n Central Repository. Attend legislative hearings and other related\r\n proceedings to monitor the status of pending legislation or law changes\r\n which could impact the Alcohol, Tobacco & Cannabis Commission. \r\n Monitor and testify before, when\r\n necessary, legislative hearings or General Assembly committee meetings. \r\n Evaluate and analyze legislation\r\n or law changes (e.g., pertaining tobacco, alcohol, cannabis / THC, ESD,\r\n etc.) and make recommendations to the Division Director or Deputy\r\n Director. \r\n Attend and participate in\r\n professional organization meetings and seminars relating to enforcement\r\n activity and current investigative trends. \r\n Address allied professional and\r\n government organizations on the current status of Maryland enforcement and\r\n investigative activity.\r\n Conduct training classes for\r\n police officers and investigators both on the recruit and In-Service\r\n levels at various police academies throughout the State and within the\r\n Field Enforcement Division and Bureau. \r\n Assist in accounting for and\r\n documenting the storage of all confiscated property to include evidence,\r\n motor vehicles and currency. \r\n Maintain knowledge of revenue\r\n laws, business regulations, and alcoholic beverages laws of Maryland, and\r\n changes of these laws, pertaining to alcoholic beverages, cigarettes,\r\n other tobacco products, cannabis / THC & ESD products and business\r\n licenses. \r\n Conduct periodic inspections of\r\n field agents' equipment, firearms and assigned vehicles to ensure\r\n compliance with Division standards. \r\n Prepare and present mid-year and\r\n annual employee performance evaluations. \r\n Other functions as directed by the Director\r\n\r\n\r\n Completes subordinates PEP's on\r\n or before due date. \r\n Other duties as assigned include\r\n those relevant to any current or future Memorandum of Understanding (MOU)\r\n such as the one between the ATCC, the MCA and the Comptroller of Maryland\r\n and any other entity.\r\n\r\nGeneral Supervision Activities Supervises and trains enforcement\r\npersonnel by:\r\n\r\n Being present with and\r\n supervising enforcement personnel assigned to various investigations and\r\n surveillances. \r\n Assisting with the planning and\r\n supervising of all types of investigations from the start to the\r\n completion of the assignment.\r\n Evaluating Field Intelligence\r\n Reports and then assigning and supervising agents to long and short-term\r\n investigations, \r\n Approving and overseeing the\r\n completion and execution of search and seizure warrants and the subsequent\r\n arrest of any violators. \r\n Reviewing reports submitted by\r\n subordinates to ensure appropriate clarity, detail, and accuracy. Ensure\r\n reports are forwarded on time. \r\n Analyze crime trends, training\r\n needs, and the merits of an agent's case through review of reports. \r\n Monitoring the coordination and\r\n results of enforcement activities between other members of the Division. \r\n Develop monthly schedule for\r\n supervisors and agents to ensure adequate supervision, staffing levels,\r\n and coverage of assignments. \r\n Promoting agent safety during any\r\n type of investigation. \r\n Preparing comprehensive reports\r\n as necessary. \r\n Monitor agent productivity via\r\n reported statistics. \r\n Regularly meet with agents to\r\n evaluate their productivity and enforcement activity and to address\r\n problems quickly. \r\n Attend court with agents to\r\n monitor their testimony. \r\n Constantly evaluates training\r\n needs and safety issues affecting staff. \r\n Other duties as assigned, to\r\n include those relevant to any current or future Memorandum of\r\n Understanding (MOU) such as the one between the ATCC, the MCA and the\r\n Comptroller of Maryland and any other entity. \r\n Keeps abreast of revenue laws,\r\n business regulation laws and alcoholic beverage laws of Maryland\r\n pertaining to alcoholic beverages, cigarettes, other tobacco products,\r\n cannabis /THC & ESD products and business licenses. Maintain NCIC\r\n computer operator certification.\r\n Available to work in the field as needed for enforcement\r\n assignments.\r\n\r\n

MINIMUM QUALIFICATIONS

Education: Graduation from an accredited high school or possession of a high school equivalency certificate as described in the Maryland Police Training Commission regulation. \r\nExperience: Five years of experience as a police officer investigating crimes including motor vehicle accidents and responding to emergency calls for police services or as an Enforcement Agent responsible for assessing and enforcing compliance to laws and regulations pertaining to commodity products such as, but not limited to, alcoholic beverage, tobacco products and related revenue laws and regulations. \r\nNotes: \r\n1. The above education requirement is set by the Maryland Police Training Commission in accordance with Public Safety Article, Section 3-209. \r\n2. Applicants may substitute additional education in criminal justice or law enforcement, at an accredited college or university, at a rate of 30 credit hours for each six months of the required experience for a maximum of two years of the required experience. \r\n3. Candidates may substitute U.S. Armed Forces military service experience as a non-commissioned officer in general inspection, investigation, enforcement, and compliance classification or general inspection, investigation, enforcement, and compliance specialty codes in the logistics field of work on a year-for-year basis for the required experience. \r\n

SELECTIVE QUALIFICATIONS

Candidates must have the following experience to qualify\r\nfor this position\r\nMust have twelve (12) months experience working as an Enforcement\r\nAgent at the ATCC.\r\n

LICENSES, REGISTRATIONS AND CERTIFICATIONS

1. Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland. \r\n2. Employees in this classification must have successfully completed the Entrance Level Police Training Course and hold a current certification by the Maryland Police Training Commission. \r\n3. After training, employees in this classification will be required to maintain periodic certification of essential marksmanship in the firing of a handgun or other firearms that may be necessary to carry out assignments. \r\n

SPECIAL REQUIREMENTS

1. Selection standards for police officer certification are established by the Maryland Police Training Commission in accordance with Public Safety Article, Section 3-209 of the Annotated Code of Maryland. These selection criteria are listed in detail in the Code of Maryland Regulations Title 12, Subtitle 04, Chapter 01 and include the following: \r\nAppointment as a police officer; \r\nU.S. Citizenship; \r\nA complete background investigation; \r\nOral interview; \r\nPhysical examination; \r\nPossession of a driver's license valid in the State of Maryland. \r\n2. Employees in this classification are subject to call 24 hours a day and must provide the agency with a telephone number where they can be reached. \r\n3. Employees in this classification are subject to substance abuse testing in accordance with Code of Maryland Regulations 17.04.09, Testing for Illegal Use of Drugs. \r\n4. Employees in this classification may be required to bear firearms and to demonstrate practical knowledge and proficiency in the safe use and care of firearms on a periodic basis. \r\n5. Employees in this classification may be subject to assignment in any area of the State. \r\n6. Employees in this classification may be subject to long hours of driving to out of State locations. \r\n7. Employees in this classification may be subject to extended workdays on a regular basis. \r\n
