Job Description

JOB SUMMARY:

The Bankruptcy Legal Assistant is responsible for several aspects of the Bankruptcy process including, but not limited to: preparing, drafting and filing Motions for Relief across multiple states, understanding all aspects of the department motion for relief process including nuances of Chapter 7,11, and 13 bankruptcies, work closely with attorneys to assist in preparing other miscellaneous pleadings such as objections to confirmation, reviewing hearing results, order preparation, and other duties as needed.

DUTIES & RESPONSIBILITIES:

  • Responsible for drafting motions for relief
    • Including but not limited to
      • Gathering information needed to assist in preparing the motion for relief
      • Prepare the motion for relief, motion to annul, and statement of default
      • Draft Chapter 13 post-petition payment histories for the Chapter 13 motion for relief
      • Review client histories and trustee ledgers for payment discrepancies
  • Responsible for direct communication with clients and attorneys
  • Responsible for declarations of default
    • Including but not limited to
      • Review expired notices of default and communicate with the client to ensure updated figures have been received
      • Draft declaration of default for client execution and upload to client site
      • Monitor for executed client declarations
      • File client declarations with the court
  • Responsible for preparation of miscellaneous pleadings
    • Including but not limited to
      • Objection to confirmation
      • Draft orders
      • Response to objection to claim
      • Response to motion to sell
      • Responses/Objections to motions to determine value
  • Responsible for attorney / court preparation and filing of pleadings and responses
    • Including but not limited to
      • Drafting consent orders
      • Updating motion and objection figures prior to hearing
      • Updating clients with hearing results
      • Obtaining all necessary information for attorneys prior to hearing

SUPERVISORY RESPONSIBILITIES:

This job does not require the exercise of supervisory responsibilities

EDUCATION & WORK EXPERIENCE:

  • A High School Diploma or GED required. Associates degree or Bachelor’s degree (B.A.) from a four-year college or university preferred
  • 1-3 years of related experience
